Up to $1,000 Total Vision Data Breach Settlement: How to Claim

What happened

Class period: There is no class period. Eligibility is based on the single Data Security Incident that happened on October 30, 2020.

• Total Vision, LLC had a data security incident on October 30, 2020.
• Total Vision mailed direct notices to affected California residents.
• Plaintiffs sued in San Diego Superior Court, saying Total Vision did not do enough to protect patient information and the information of others. The case is Ramey, et al. v. Total Vision, LLC, et al., Case No. 37-2021-00002017-CU-MC-CTL.
• Total Vision denies any wrongdoing. No court has found that it did anything wrong.
• To end the case, Total Vision agreed to pay a Gross Settlement Amount of $475,000.
• Total Vision also agreed to keep improved data security measures in place for at least two years. The company says those measures are worth more than $224,000 a year, and it pays for them separately from the $475,000.
• The official notice does not list which types of personal information were involved in the incident.

How to file

1. Find your mailed Class Notice. The online form asks for your ILYM ID and Claim ID, which are printed in the bottom right corner of the notice
2. Go to https://totalvisionsettlement.com/claim-form, sign in with your ID numbers and last name, and complete the form
3. For the Pro-Rata Cash Payment only, you can file online or mail a paper Claim Form
4. For Documented Out-of-Pocket Expenses, you must print a Claim Form, attach your supporting documents, and mail it. This part cannot be filed online, by phone, or by email
5. Mail paper forms to: Total Vision Settlement, c/o ILYM Group, Inc., P.O. Box 2031, Tustin, CA 92781
6. If you do not have a Claim Form, call the administrator at (888) 250-6810 and ask for one
7. Submit or postmark by October 5, 2026. See the deadline note in Extra details below and consider filing earlier

Proof required

• Pro-Rata Cash Payment: no documents required
• Documented Out-of-Pocket Expenses: adequate documentation for each loss or expense listed on your Claim Form
• Losses must be fairly traceable to the October 30, 2020 Data Security Incident
• Expense claims and their documents must be mailed on paper. The website, phone line, and email will not accept them
• The online portal requires the ILYM ID and Claim ID from your mailed notice, so you need the notice to file online

Payment timing

Payments go out only if the court grants final approval and after any appeals are finished. The Final Approval Hearing is set for December 18, 2026. ILYM Group, Inc. handles the mailing of settlement checks.

• Deadline warning. The official site gives two different claim deadlines. The Home page, the footer on every page, and the mailed notice all say October 5, 2026. The Submit a Claim page says September 21, 2026. Until the administrator fixes this, treat September 21, 2026 as your real deadline. Filing early costs you nothing.
• You need your mailed notice to file online. The portal will not let you in without the ILYM ID and Claim ID printed on it.
• Expense claims are paper only. If you have receipts to submit, budget time for postal mail.
• No one can quote the Pro-Rata Cash Payment in advance. It is the leftover fund split among everyone who files.
• The $475,000 fund is small and the requested deductions are large. Class Counsel will ask the court for fees of up to $158,333.33 plus about $22,000 in costs, administration costs of up to $100,250, and $5,000 service awards for each of the two Class Representatives. If the court approves all of it, roughly $184,000 is left for claims.
• Expense reimbursements can also be cut pro rata if approved claims run high.
• The improved data security measures are automatic. You do not file anything for those.
• If you do nothing, you stay in the class, get no money, and give up your right to sue Total Vision over this incident.
• You cannot exclude yourself or object by phone, email, or through the website. Both require mail postmarked by September 4, 2026.
• Do not contact the court or Total Vision. Send claim questions to ILYM Group.
• Only one official site exists for this case. Ignore any other site or message asking for payment or account logins.
