$75 or Up to $5,000: ApolloMD Data Breach Settlement

What happened

Class period: There is no purchase date range. Eligibility is based on the May 22 to May 23, 2025 Data Incident and whether ApolloMD sent you a notice about it.

• ApolloMD Business Services LLC provides staffing and billing support for physicians and medical practices. Most patients never deal with it directly, but it holds their records.
• On or about May 22, 2025, ApolloMD found unusual activity in its computer network. It later learned that between May 22 and May 23, 2025, an unauthorized outside party may have accessed or taken files holding patient Private Information.
• The information involved some mix of names, dates of birth, addresses, diagnosis information, provider names, dates of service, treatment information, health insurance information, and Social Security numbers.
• ApolloMD mailed notices in two waves. The first wave started September 17, 2025. The second wave went out in March 2026.
• The lawsuit claims negligence and breach of implied contract, among other things. ApolloMD denies all of it and says it did nothing wrong.
• The case is In re ApolloMD Data Breach Litigation, Case No. 1:25-cv-05439-SEG, in the United States District Court for the Northern District of Georgia, Atlanta Division.
• ApolloMD agreed to pay $4,020,000 into a Settlement Fund. Kroll Settlement Administration LLC is handling claims.

• You were sent a notice of the ApolloMD Data Incident saying your Private Information may have been impacted
• Your notice came in one of two mailings, starting September 17, 2025 or in March 2026
• You are not an ApolloMD officer, director, parent, subsidiary, or affiliate
• You are not a government body, a judge assigned to this case, or an immediate family member of one
• You have not been found guilty of criminal activity connected to the Data Incident

How to file

1. Go to https://www.apollomddatasettlement.com/ and open the Submit Claim page
2. Have your notice handy. It contains your Class Member ID
3. Choose one cash option: Cash Payment A for documented losses up to $5,000, or Cash Payment B for about $75. You cannot claim both
4. Add the request for one year of Medical Data Monitoring if you want it. It can be claimed alongside either cash option
5. Upload supporting documents only if you are claiming Cash Payment A
6. Submit online by 11:59 p.m. ET on September 30, 2026, or mail the form postmarked by that date to: Settlement Administrator - #83375, c/o Kroll Settlement Administration LLC, P.O. Box 5324, New York, NY 10150-5324

Proof required

• Cash Payment B, the roughly $75 alternate cash payment, requires no documentation
• Medical Data Monitoring requires no documentation
• Cash Payment A, up to $5,000, requires reasonable third-party documentation of losses from fraud or identity theft tied to the Data Incident
• Acceptable examples include telephone records, correspondence such as emails and letters, and receipts
• Your own certification, declaration, or affidavit does not count as proof by itself, though you can attach one to explain other documents
• If a Cash Payment A claim is rejected and you do not fix it, it converts to a Cash Payment B claim, so you do not walk away with nothing

Payment timing

Payments go out only after the Court grants Final Approval and any appeals are resolved. The Final Approval Hearing is set for October 5, 2026. The settlement website does not list which payment methods will be offered. Money leaves the Net Settlement Fund in a set order: Medical Data Monitoring first, then Cash Payment A documented losses, then Cash Payment B alternate cash.

Extra details

• Nothing is automatic. If you do nothing, you get no benefits and you still give up the right to sue ApolloMD over the claims this settlement resolves.
• Cash Payment A and Cash Payment B are an either-or choice. Medical Data Monitoring stacks on top of whichever one you pick.
• All cash amounts are estimates. Every payment is adjusted pro rata based on how many valid claims come in and how much is left in the fund.
• Because the fund pays monitoring first and documented losses second, the roughly $75 alternate cash payment is the tier most likely to shrink.
• Class Counsel will ask the Court for attorneys' fees of up to 33 percent of the fund, which is $1,340,000, plus costs. That comes out of the $4,020,000 before class members are paid.
• Class Counsel are Jeff Ostrow of Kopelowitz Ostrow P.A. and Casondra Turner of Milberg PLLC. You are not billed for them.
• The monitoring product comes from CyEx and covers one credit bureau, dark web scanning, security freeze help, victim assistance, fraud resolution agents, and $1,000,000 in identity theft insurance with no deductible.
• Opting out must be done by mail with a signed letter postmarked by August 31, 2026. That deadline is a full month before the claim deadline, so it arrives sooner than people expect.
• The objection requirements include a line asking whether you or your lawyer used artificial intelligence to write the objection. That is a new one, and it is in the official FAQ.
• File only at apollomddatasettlement.com. Health data breaches attract scam calls and fake claim sites.
