Up to $5,000 Serviceaide Data Breach Settlement: How to Claim

What happened

Class period: September 19, 2024 through November 5, 2024

• Serviceaide, Inc. is a technology vendor that provides AI-powered service management software. Catholic Health, a nonprofit health system based in Buffalo, New York, hired Serviceaide for work that gave it access to patient data.
• Between September 19, 2024 and November 5, 2024, an unauthorized third party got into Serviceaide's computer systems and network. Private information belonging to current and former Catholic Health patients was potentially exposed.
• Court filings estimate the settlement class at about 480,000 people. Notices went out starting May 9, 2025.
• Eleven separate lawsuits were filed and later combined into one case, Nancy Balzer, et al., v. Serviceaide, Inc., Index No. 625615/2025, in the Supreme Court of the State of New York, County of Nassau.
• The lawsuit claims negligence, breach of implied contract, unjust enrichment, and invasion of privacy. Serviceaide denies all wrongdoing and settled to avoid the cost and risk of a trial.
• Serviceaide agreed to fund a $1,800,000 settlement. That fund pays claims, notice and administration costs, attorney fees and costs, and service awards for the class representatives.
• The court gave the settlement preliminary approval on May 21, 2026. Final approval is still pending.

How to file

1. Find your Class Member ID on the notice you received in the mail. The online claim form requires it.
2. Go to the official settlement website at https://serviceaidedatasettlement.com/ and select Submit Claim
3. Enter your Class Member ID, then fill in your name and contact information
4. Pick one payment option: Cash Payment A for documented losses, or Cash Payment B for the alternate cash payment
5. If you are claiming documented losses, upload your supporting documents
6. Sign the attestation and submit online by September 1, 2026
7. If you do not have a Class Member ID, download the paper claim form from the Documents page and mail it postmarked by September 1, 2026

Proof required

• For the Alternate Cash Payment of about $50, no documents are required
• For the Documented Loss Payment of up to $5,000, you must attach third-party proof of your losses
• Accepted proof may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges, telephone records, and police reports
• Covered costs include fraudulent charges, bank fees, credit monitoring or identity theft protection you bought after the breach, credit freezes, professional fees, replacement ID costs, long-distance phone charges, and postage
• If your documented loss claim is found incomplete, the administrator may convert it to an Alternate Cash Payment instead

Payment timing

Payments cannot be sent until the court grants final approval and any appeals are resolved. The Final Approval Hearing is set for September 16, 2026 at 10:00 a.m. ET. Documented loss claims are paid first, and the alternate cash payments are then paid pro rata from what is left in the fund, so the final amount may be higher or lower than $50. • You can only pick one payment option. You cannot claim both the documented loss payment and the alternate cash payment.
• The $50 figure is an estimate, not a promise. It moves up or down based on how many valid claims come in.
• Objecting and opting out are not the same thing. If you opt out, you keep your right to sue but get nothing from the settlement. If you object, you stay in the class and can still file a claim.
• Doing nothing means you get no money and still give up your right to sue over these claims.
