What happened

Class period: October 19, 2021 through July 14, 2026

  • TED Foundation Inc. runs TED.com and the TED mobile apps.
  • A class action claims TED shared users' personally identifiable information with third-party service providers without users' informed, written consent, in violation of the Video Privacy Protection Act (VPPA), 18 U.S.C. § 2710.
  • Under the VPPA, that includes information showing which specific videos a person requested or watched.
  • TED denies any wrongdoing. TED says it never disclosed account holders' names or email addresses together with their video views, that the data stored with third parties was encrypted, and that the software was for internal use. The Court has not decided who is right.
  • Both sides agreed to settle to avoid the cost and risk of continuing the case. The case is Sutton v. TED Foundation Inc., Case No. 1:23-cv-09219-DEH, in the United States District Court for the Southern District of New York.
  • TED also agreed to changes going forward: an affirmative consent option for U.S. account holders whose event data goes to Open Web, and an end to sending U.S. account holders' first and last names or email addresses to Mixpanel. TED confirmed it no longer uses Leanplum.

Payment timing

The Final Approval Hearing is set for November 12, 2026. If the Court approves the settlement, payments go out 60 days after final approval and after any appeals are finished. Cash is paid by check unless you elect PayPal or Venmo. Checks expire and become void 180 days after they are issued. Membership activation links are sent on the same 60-day timeline.

  • If you pick cash or the donation option, you do not get the TED Membership Benefit
  • The cash pool is capped at $350,000, so a $5.00 payment can be cut pro rata if a lot of people file
