What happened

Class period: February 6, 2019 through May 7, 2025

  • The Money Source, Inc. (TMS) is a mortgage lender and servicer. It was sued in federal court in Arizona in the case Natasha Hiller v. The Money Source, Inc., Case No. 2:23-cv-00235-PHX-JJT.
  • Natasha Hiller says TMS kept calling cell phones with a prerecorded or artificial voice after people had already asked the company to stop making those calls.
  • The lawsuit says those calls broke the Telephone Consumer Protection Act (TCPA), a federal law that limits automated calls.
  • TMS denies the calls were unlawful and says it acted in good faith. The court has not ruled on who is right.
  • To end the case, TMS agreed to pay $1,500,000 into a settlement fund.
  • The class covers people in the United States and its territories who got those calls between February 6, 2019 and May 7, 2025, based on the company's own business records.

How to file

  1. There is nothing to file. Notices went out by mail and email on July 24, 2026 to everyone the company identified from its records
  2. If you received a notice and do nothing, a payment will be sent to you after the settlement is approved
  3. Complete and return a W-9 to the administrator so your payment is not reduced by backup withholding. The form is available in the settlement documents section of the official site
  4. Return the W-9 by email to MoneySourceTCPAClassAction@AtticusAdmin.com, by fax to 1-888-326-6411, or by mail to The Money Source Settlement Administrator, PO Box 64053, St. Paul, MN 55164
  5. If you moved or your contact information changed, call the administrator at 1-800-679-0774 so your payment reaches you

Proof required

  • No claim form and no proof of the calls. Eligibility comes from The Money Source's own business records
  • A signed W-9 is requested so the administrator can meet IRS reporting rules
  • A taxpayer identification number is required if your payment is more than $2,000
  • If you do not provide the information, the administrator will withhold 24% for the IRS and send it on. You can claim that amount as a credit or refund when you file your federal tax return

Payment timing

Nothing is paid until the court approves the settlement at the November 16, 2026 hearing and any appeals are resolved, which the notice says can take more than a year. Payments are pro rata from the $1.5 million fund after attorneys' fees, administration costs, litigation expenses up to $17,000, and a service award to the plaintiff are deducted. Payments may be subject to IRS reporting.

Extra details

  • No claim form exists. Payments go automatically to the people TMS identified in its records
  • Your payment size depends on how many qualifying calls you received, so amounts will differ from person to person
  • Opting out by October 7, 2026 is the only way to keep your right to sue on your own. Opting out also means no payment
  • Group or joint opt-outs and objections are not allowed. Each person must submit their own
  • The release is broad. It covers all claims that were or could have been brought over prerecorded or artificial voice calls, including claims under the TCPA, other statutes, and common law, not just the specific claims in the complaint
  • Attorneys will ask the court for up to one third of the fund, which reduces the amount left for class members
  • Do not call or write the court, the clerk, or the company's lawyers about this settlement. Use the administrator
  • Watch for scams. Only use the official site listed above

FAQ

Who qualifies for The Money Source TCPA settlement?
You qualify if The Money Source called your cell phone with a prerecorded or artificial voice between February 6, 2019 and May 7, 2025, after you had asked the company to stop making those calls, and your number appears in the company's business records.
Do I have to file a claim?
No. There is no claim form. Notices went out by mail and email on July 24, 2026, and everyone identified as a class member who does not opt out will be sent a payment. Doing nothing is, for once, the correct strategy.
How much money will I get?
The fund is $1,500,000. Each payment is a pro rata share based on how many qualifying calls you received, after attorneys' fees, administration costs, litigation expenses, and the plaintiff's service award are deducted. The notice does not give a per-person estimate.
What is the deadline?
October 7, 2026 is the deadline to opt out or object. There is no claim deadline because there is no claim to file.
Do I need to send in any paperwork?
You should return a signed W-9 so the administrator can report the payment to the IRS. If your payment is more than $2,000, a taxpayer identification number is required. If you skip it, 24% is withheld and sent to the IRS, and you would have to recover it on your tax return.
When will payments go out?
After the November 16, 2026 final approval hearing and after any appeals are resolved. The notice warns that appeals can take more than a year.
What happens if I opt out?
You get no payment, but you keep the right to sue The Money Source on your own over these calls. Your written exclusion request must be postmarked by October 7, 2026 and mailed to the administrator in St. Paul, MN.
What rights am I giving up if I stay in?
You release all claims tied to The Money Source placing prerecorded or artificial voice calls to you. That release is wider than the specific TCPA claims in the complaint, so it also covers other statutes and common law claims about those calls.
Who do I contact with questions?
Call the administrator at 1-800-679-0774 or email MoneySourceTCPAClassAction@AtticusAdmin.com. Do not contact the court or the company's lawyers.
