Up to $160 Farmers TCPA Settlement: How to Claim (No Proof)

What happened

Class period: April 19, 2020 through June 15, 2026

• A class action called Spencer Heckathorn v. Fire Insurance Exchange was filed in the Circuit Court of St. Louis County, Missouri (Case No. 26SL-CC03879, Division 17)
• The lawsuit claims insurance agents Nickolas Ward, Nate Esparza, Kyle Ryan Gray, Dustin Huffman, Jason Hall, Brian Shirey, and LeNard Rhone, and their agencies, called and texted people to market Farmers insurance
• Those calls and texts went to phone numbers listed on the National Do-Not-Call Registry, which the lawsuit says violates the federal Telephone Consumer Protection Act (47 U.S.C. section 227)
• Farmers denies the claims and says it settled to avoid the cost and risk of a trial
• Farmers Insurance Exchange, Farmers Insurance Company, Inc., and Fire Insurance Exchange agreed to make up to $1,250,000 available
• Court records show about 12,545 people may have received these calls or texts between April 19, 2020 and June 15, 2026

• You received two or more calls or text messages in a 12-month period from Nickolas Ward, Nate Esparza, Kyle Ryan Gray, Dustin Huffman, Jason Hall, Brian Shirey, LeNard Rhone, or their agencies marketing Farmers insurance
• Your number had been on the National Do-Not-Call Registry for more than 30 days when the calls came in
• The number is registered to you as an individual, not to a business
• Your phone number appeared on a list produced in the case
• You did NOT visit a website to ask Farmers or its agents for an insurance quote before the calls or texts
• You were NOT a Farmers customer when you got the calls or texts, or in the 18 months before
• You are not Farmers counsel, a Farmers officer, director, or employee, an immediate family member of one, or a member of the Missouri judiciary

2. Sign the Claim Form and upload it through the site, which is the fastest of the three options
3. Or sign the Claim Form that came with your postcard notice and mail it to Heckathorn TCPA Settlement, c/o Atticus Administration, PO Box 64053, St. Paul, MN 55164
4. Or email a signed Claim Form to HeckathornTCPASettlement@atticusadmin.com
5. Need a blank form? Get one on the Settlement Documents page, or call 1-800-261-9045
6. Online claims and mailed claims must be in or postmarked by September 14, 2026

Proof required

• No phone bills, screenshots, or call logs are required
• You must sign the Claim Form, which certifies two things under penalty of perjury
• First, that you did not visit any website to request an insurance quote from Farmers or its agents before the calls or texts
• Second, that you were not a Farmers customer when the calls or texts came in, or in the 18 months before

Payment timing

Payments go out only if the Court approves the settlement at the September 23, 2026 hearing and any appeals are resolved. Valid claims should get a check from the Settlement Administrator within 60 days after that. Checks expire and become void 180 days after they are issued, so cash it when it arrives.

• The $160 figure is a ceiling, not a promise. Payments are pro rata, so the more people who file, the smaller each check gets
• Filing is the only way to get paid. Doing nothing gets you no money and still gives up your right to sue over these calls
• To keep your right to sue on your own, mail an exclusion request postmarked by August 27, 2026
• If you object to the settlement, the parties can ask you questions and may require you to sit for a deposition on 10 days notice
