What happened

Class period: Not tied to a purchase window -- the class is based on notice of the July 2025 data incident. Documented losses must have occurred between July 9, 2025 and November 2, 2026.

• Modernizing Medicine, Inc. (ModMed) makes electronic health record (EHR) software used by medical practices
• In July 2025, a targeted cyberattack hit two ModMed servers that were being used to move limited data from retiring EHR platforms into ModMed's current platform
• Files accessed in the attack may have held full names, addresses, dates of birth, phone numbers, email addresses, Social Security numbers, health insurance information, and medical information such as record numbers, dates of service, provider names, billing and diagnostic codes, prescriptions, and diagnosis and treatment details
• A class action lawsuit, Cavallaro-Kearins v. Modernizing Medicine, Inc. (Case No. 9:25-cv-81443-EA, U.S. District Court for the Southern District of Florida), followed
• ModMed denies any wrongdoing but agreed to a $2,999,750 settlement fund to avoid the cost and risk of trial
• It affects anyone living in the United States who was sent a notice that their information was involved in the data incident

How to file

1. Go to the official settlement website at modernizingmedicinedatasettlement.com
2. Click "Submit a Claim" and use the login information from your notice
3. Choose Cash Payment A (documented losses, up to $5,000) or Cash Payment B (flat $75, no proof)
4. Enroll in the two years of Medical Data Monitoring on the same form
5. If claiming documented losses, upload receipts, statements, or other third-party records
6. Alternatively, download a paper Claim Form from the Important Documents page and mail it postmarked by November 2, 2026

Proof required

• No proof is needed for the $75 Alternate Cash Payment or the Medical Data Monitoring
• For the Documented Loss Payment, you must submit reasonable documentation created by a third party, such as receipts, bank or phone records, or emails
• A personal statement or affidavit alone does not count as proof, though it can be added to explain your other documents
• Losses already reimbursed by another source, including ModMed's original credit monitoring offer, do not qualify
• If your documented loss claim is rejected and not fixed, it is treated as a $75 Alternate Cash claim

Payment timing

Cash payments and monitoring activation codes go out after the Court grants final approval and any appeals are resolved. The final approval hearing is set for November 17, 2026.
