6% Sales Tax Plus $23: USAA Michigan Total Loss Settlement
By eosguide editorial · Last updated
USAA Michigan total loss settlement: claim the unpaid 6% sales tax on your leased vehicle plus $23 in title and registration fees. File by Oct 8, 2026. One line item here is an $8 registration fee, which took a federal case and five years to shake loose, and it is still your $8.
What happened
Class period: January 27, 2015 through March 11, 2026
- The lawsuit says United Services Automobile Association (USAA) did not pay the full Michigan sales tax and vehicle regulatory fees on totaled leased vehicles.
- It covers people who insured a leased vehicle under a USAA Michigan auto policy, filed a comprehensive or collision claim, and had the vehicle declared a total loss.
- Michigan law sets the sales tax at 6 percent, the title transfer fee at $15, and the vehicle registration fee at $8. The suit says those amounts were short or missing from total loss payouts.
- USAA denies doing anything wrong and says it met Michigan law and its policy terms. It agreed to settle to end the case.
- The case is Marchek v. United Services Automobile Association, Case No. 1:21-cv-00087, in the U.S. District Court for the Western District of Michigan.
