Class period: April 15, 2021 through June 29, 2026
- Sherry Bryan sued O'Reilly Automotive, Inc. under the federal Telephone Consumer Protection Act (TCPA), the law that governs unwanted marketing calls and texts.
- The lawsuit says O'Reilly sent text messages to phone numbers that were listed on the National Do-Not-Call Registry, and did it without consent.
- The twist in this case is reassigned numbers. When a phone number is given up and handed to a new customer, marketing lists often do not catch up. The lawsuit says O'Reilly kept texting those numbers after they belonged to someone new.
