$5.57M FN Logistics Wage Settlement: How to Claim

What happened

Class period: January 13, 2019 through December 31, 2024. The PAGA period is October 2, 2021 through December 31, 2024.

• FN Logistics, LLC (FNL) ran California warehouse operations using hourly, non-exempt employees plus temporary workers placed by staffing agencies.
• Former workers sued in Los Angeles Superior Court, Case No. 22STCV26948, known as Bucio et al. v. FN Logistics, LLC.
• The lawsuit says FNL failed to pay all overtime wages, failed to pay overtime at the required rates, failed to pay minimum wages, failed to pay wages on time during work or at termination, failed to reimburse expenses, failed to provide required meal periods or rest breaks, failed to provide accurate itemized wage statements, failed to provide sick days and sick pay, failed to provide suitable seating, and failed to maintain suitable temperatures.
• Plaintiffs also brought a claim for civil penalties under California's Private Attorneys General Act (PAGA).
• FNL denies breaking any law and says it followed all applicable rules. The court has not decided who is right.
• To end the case, FNL agreed to pay $5,565,000 as the Gross Settlement Amount. The parties used a retired judge to negotiate the deal.
• The settlement releases claims against FNL, its staffing agencies, and its parent companies, which the settlement lists as including Fashion Nova LLC.
• It affects current and former hourly, non-exempt California workers and staffing agency temps who worked between January 13, 2019 and December 31, 2024.

• You worked as an hourly, non-exempt employee for FN Logistics, LLC or its predecessor FN Logistics, Inc. in California at any time from January 13, 2019 through December 31, 2024
• You were a temporary worker placed at an FN Logistics California location during that period through a staffing agency, including Adecco, Bluecrew, Personal HR, Randstad, Next Level Staffing, IWC, Compliant Care Staffing, Driven Talent, or Eastridge
• You received a mailed notice about this settlement, which means you are already in the class
• You also worked at any time from October 2, 2021 through December 31, 2024, which adds a separate PAGA payment

How to file

1. If you received mailed notice, do nothing. Your check is sent automatically if the court grants final approval.
2. If you did not receive notice but believe you are in the class, download the claim form at https://buciovfnlogisticsclassaction.com/form/claim
3. Attach copies of pay stubs or other records that prove the workweeks you are claiming. Send copies only, since documents are not returned.
4. Mail the completed form and documents through the U.S. Postal Service to: Bucio v. FN Logistics, LLC, c/o Settlement Administrator, P.O. Box 26170, Santa Ana, CA 92799-9958
5. Time the mailing so the form is received by October 26, 2026. Received, not postmarked.
6. Do not mail or deliver the form to the court, the settling parties, or their lawyers.

• No documents at all if you received mailed notice. Payment is automatic.
• Copies of pay stubs or other work records proving your claimed workweeks, if you are filing a claim form because you did not get notice
• Copies of pay stubs or other records if you disagree with the workweeks or pay periods credited to you on your notice, due October 26, 2026
• Copies only. The administrator keeps what you send.

Payment timing

Checks are mailed by the Settlement Administrator after the court grants final approval and the judgment becomes final. FNL funds the settlement within 30 days after that point. Participating class members get one check combining the class payment and any PAGA payment, sent to the address on the notice. Cash it before the void date printed on the check, or the money goes to the California Controller's Unclaimed Property Fund in your name.

• If you received mailed notice, you do not need to file anything to get paid
• Taxes: the parties propose treating 20% of each class payment as wages reported on a W-2, and 80% as interest and penalties reported on a 1099. PAGA payments are reported on a 1099. Ask a tax advisor about your own situation.
• You cannot opt out of the PAGA part of the settlement. Even if you exclude yourself from the class portion, you still get any PAGA payment and still give up PAGA claims.
• Opting out means no class payment, but you keep the right to pursue your own wage and hour claims against FNL
