Class period: The Data Incident occurred on or about April 29, 2024. Eligibility is based on receiving a notice from Equinox, not on a date range of purchases.

  • On or about April 29, 2024, Equinox, Inc. found suspicious activity and possible unauthorized access to its network.
  • An investigation showed that cybercriminals had unlawfully accessed people's Private Information. Equinox brought in outside advisors and cybersecurity experts and notified law enforcement.
  • The information involved includes names, addresses, dates of birth, Social Security numbers, driver's license numbers, health insurance information, medical treatment or diagnosis information, medication information, financial information, provider name, and MRN/patient ID.
  • Equinox mailed notices to the people whose information may have been affected.
  • Two lawsuits followed: McHugh v. Equinox, Inc. (Index No. 911677-24) and Carter v. Equinox, Inc. (Index No. 901198-25), both in the Supreme Court of the State of New York, Albany County.
  • Equinox denies the claims and denies doing anything wrong. No court has ruled that Equinox did anything wrong. The parties agreed to settle instead of going to trial.

Payment timing

Payments are issued after the settlement is approved and becomes final, using the payment method you select on the Claim Form. Credit monitoring activation codes are sent within 30 days of the Effective Date. Approval can take time and appeals may delay payment. If your contact or payment information changes after you file, notify the administrator and include your Notice ID number.

  • The $100 figure is an estimate, not a promise. It is a pro rata share of what is left in the fund, so it moves up or down depending on how many valid claims come in.
