What happened
Class period: The data incident occurred in April 2025. Out-of-pocket losses must have occurred between April 3, 2025 and September 12, 2026.
- In April 2025, attackers targeted the computer systems of Payactiv, Inc., an earned wage access and payroll services company
- Files containing private information were accessed during the attack
- Those files may have held names, dates of birth, financial account numbers, and Social Security numbers
- A class action was filed, Susan Toth, et al. v. Payactiv, Inc., Case No. CACE-26-005865, in the Circuit Court of the 17th Judicial Circuit in and for Broward County, Florida
- Payactiv denies doing anything wrong. The Court has not decided who is right. Both sides agreed to settle to avoid the cost and risk of a trial
- The settlement covers living adults in the United States who were sent a notice from Payactiv about the incident

Who may qualify
- You are a living adult who resides in the United States
- Payactiv sent you a notice that your private information may have been impacted in the April 2025 data incident
- You do not opt out of the settlement
- You are not a director, officer, or agent of Payactiv, a governmental entity, or the assigned Judge, that Judge's immediate family, or Court staff
How to file
- Go to https://www.payactivdataincidentsettlement.com/form/claim
- Log in with the LoginID and PIN from your notice. They are printed on the front of the postcard above your name and address, or at the bottom right of the email notice
- If you cannot find your LoginID and PIN, email info@PayactivDataIncidentSettlement.com with your full name and mailing address to request them
- Complete the form and upload proof of your out-of-pocket losses
- Submit online by September 12, 2026
- To file by mail instead, download the Claim Form from the site and send it with your proof to Payactiv Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25191, Santa Ana, CA 92799-9958, postmarked no later than September 12, 2026

Proof required
- Bank statements, receipts, invoices, or similar records showing how much you spent or lost
- The proof must show the expense was caused by the data incident
- Notes or papers you wrote yourself may support other proof, but they are not enough on their own
- Losses must have occurred between April 3, 2025 and September 12, 2026
- You cannot claim expenses that a third party already reimbursed
- Covered expenses include identity theft or fraud losses, credit report and credit freeze fees, the cost to replace IDs, and postage to contact banks
- The two years of credit monitoring require no proof and no claim form, only the enrollment code from your notice
Payment timing
The Final Approval Hearing is set for October 12, 2026. Payments will be distributed if the Court grants final approval and after any appeals are resolved. Payment methods are not listed on the official site.

- The two years of credit monitoring is separate from the claim form. Enrollment codes were mailed or emailed to all class members
- If you no longer have your enrollment code, contact the Settlement Administrator to get it replaced
- The Enrollment Instructions Request page on the official site will be updated when the enrollment period opens
- Class counsel will ask the Court to approve $700,000 in fees and costs, and $1,500 service awards for each Class Representative. Payactiv pays both, so they do not reduce class member benefits
- Do not contact the Court or the Clerk of Court about this settlement. Contact the Settlement Administrator instead
