$14.5M CRST Truck Driver Settlement: No Claim to File

What happened

Class period: August 9, 2017 through April 10, 2023 for the Class. August 9, 2020 through April 10, 2023 for PAGA Group Members.

• CRST Expedited, Inc. is a long-haul trucking company that paid many California drivers by the mile, known as piece-rate pay
• Driver Keith Huckaby sued CRST Expedited, Inc. and CRST International, Inc. He claimed drivers were not paid minimum wage for time spent not driving, such as waiting at customer sites, breakdowns, weather delays, layovers, and time in the sleeper berth
• The lawsuit also claimed CRST failed to pay wages based on actual miles driven, failed to reimburse business expenses, gave inaccurate wage statements, paid wages late, and broke California's Unfair Competition Law
• A related claim was filed under California's Private Attorneys General Act, or PAGA, which lets a worker seek civil penalties on behalf of the state
• The case is Keith Huckaby v. CRST Expedited, Inc., et al., Case No. 2:21-cv-07766-ODW-PD, in the U.S. District Court for the Central District of California
• CRST denies all of it and says its pay practices were legal. It agreed to settle to end the cost and risk of the lawsuit
• CRST will pay $14,500,000 to resolve the case

• You worked as a truck driver for CRST Expedited, Inc.
• You were paid by piece-rate at some point between August 9, 2017 and April 10, 2023
• You were not a participant in the earlier settlement of Montoya v. CRST Expedited, Inc.
• For the added PAGA payment, you must have been paid piece-rate at some point between August 9, 2020 and April 10, 2023

How to file

1. Do nothing. There is no claim form for this settlement
2. Confirm the Settlement Administrator has your correct mailing address. Call (833) 930-1150 or use the contact form at https://truckingdriversettlement.com/
3. If your Postcard Class Notice lists the wrong number of qualifying workweeks or pay periods, mail a signed written dispute with supporting records, postmarked by October 5, 2026
4. Cash your check within 180 days. Uncashed checks are canceled and the money goes to a charity chosen by the Court

Proof required

• No documents are required. CRST's payroll records set your payment amount
• Proof is only needed if you disagree with the workweek or pay period count on your notice. In that case you must send documents that show a mistake was made
• CRST's count is treated as correct unless your records prove otherwise

Payment timing

Payments are made by check. CRST deposits the $14,500,000 into the settlement fund within 30 days of the Effective Date, which is when the Court approves the settlement and any appeals are finished. Checks are mailed within 15 days after that. The final approval hearing is set for November 16, 2026.

• The $14,500,000 is the total. It covers driver payments, attorney fees of up to $4,833,333.33, litigation costs of up to $410,000, administration costs of about $60,703, a $15,000 service award to the Class Representative, and $725,000 in PAGA penalties
• Of the PAGA money, $543,750 goes to the State of California and $181,250 is split among PAGA Group Members
• One-third of your class payment is treated as wages and taxed. One-third is interest and one-third is penalties, both reported on a 1099
• If you stay in, you give up the right to sue CRST over these wage and hour claims, including claims under the Fair Labor Standards Act
• You cannot opt out of the PAGA release. Even drivers who opt out of the class still release PAGA claims and still get their PAGA payment
• Opting out means no class payment. Your signed request must include the last four digits of your Social Security number and be postmarked by October 5, 2026
