What happened

Class period: Data incident discovered around November 14, 2023. Documented losses must have occurred from November 2023 through the date you submit your claim.

• Around November 14, 2023, Medical Management Resource Group LLC, doing business as American Vision Partners, discovered a cyberattack on its computer network
• An unauthorized third party accessed the information of about 1.6 million people, including names, dates of birth, Social Security numbers, contact information, medical treatment details, and health insurance information
• The lawsuit, Hulewat et al. v. Medical Management Resource Group LLC d/b/a American Vision Partners, et al., Case No. 2:24-cv-00377-DJH, is pending in the U.S. District Court for the District of Arizona. Barnet Dulaney Perkins Eye Center and Southwestern Eye Center are also defendants
• The defendants deny any wrongdoing, and no court has found they did anything wrong. Both sides agreed to settle to avoid the cost and risk of a trial
• The settlement creates a $1,750,000 fund for about 258,070 U.S. residents whose Social Security numbers were compromised. It also requires the defendants to adopt new cybersecurity measures valued at about $2.79 million

How to file

1. Go to the official settlement website and click "Submit Claim"
2. Choose one option: the pro rata cash payment, or an out-of-pocket expense claim
3. If you choose the expense claim, upload receipts or other third-party documents and complete the attestation
4. Submit online by November 12, 2026 to be eligible for electronic or ACH payment
5. Or mail a paper Claim Form to Settlement Administrator – 83312, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391, postmarked by November 12, 2026

Proof required

• The pro rata cash payment needs no proof
• Out-of-pocket expense claims (up to $3,000) require receipts or other documents not prepared by you, plus a signed attestation that the losses came from the data incident
• Handwritten or self-prepared notes are not enough on their own but can support other documents
• Covered expenses include fraud or identity theft losses, credit freeze costs, credit monitoring bought after November 2023, professional fees, and small costs like postage, notary, or mileage

Payment timing

Payments go out after the Court grants final approval at the December 2026 hearing and any appeals are resolved. To get paid by electronic or ACH payment, you must file online. Mailed claims are paid by check.

• The other roughly 1.3 million affected people are in the Injunctive Relief Class. Their benefit is the new cybersecurity measures, with no payment and no claim to file
