Allstate Arizona Depreciation Settlement: 50% Back + Interest
By eosguide editorial · Last updated
Allstate Arizona depreciation settlement: get back 50% of withheld nonmaterial depreciation plus 10% interest, or $10 to $360. File by Jan 29, 2027. The lawsuit says Allstate depreciated things like removal work and contractor overhead, which is a bold way to say a job got old before anyone did it.
What happened
Class period: April 25, 2017 through October 1, 2026 (based on the date of the initial ACV payment)
- The lawsuit says Allstate improperly deducted Nonmaterial Depreciation when it paid some Arizona structural damage claims.
- Nonmaterial Depreciation means using the "depreciate removal," "depreciate non-material," or "depreciate O&P" settings in Xactimate or similar estimating software.
- These deductions lowered the actual cash value (ACV) payments that policyholders received.
- The case is Hernandez v. Allstate Vehicle and Property Insurance Company, Case No. CV-2026 00048, in the Superior Court of Arizona for Mohave County.
- Allstate denies wrongdoing. The Court has not decided who is right, and both sides agreed to settle.
- It affects Allstate policyholders who received an ACV payment for Arizona structural damage between April 25, 2017 and October 1, 2026 with Nonmaterial Depreciation withheld.
What you can get
Unpaid Nonmaterial Depreciation
50% plus 10% annual interest
For class members whose nonmaterial depreciation was not repaid (the majority); simple interest from the initial ACV payment to the Effective Date
Fully Recovered Depreciation
$10 to $360
One-time payment if you recovered all depreciation through the claim process; amount depends on nonmaterial depreciation withheld
