- A class action lawsuit, Minter v. FinWise Bank et al., Case No. 2:25-cv-00569-JNP-CMR, was filed in the U.S. District Court for the District of Utah
- The defendants are FinWise Bank, FinWise Bancorp, and American First Finance
- The defendants deny any wrongdoing but agreed to a $2,800,000 settlement to avoid the cost and risk of a trial
- The settlement covers people living in the United States whose information was affected, including everyone who was sent a notice of the data incident

Who may qualify
- Your private information was affected by the FinWise Bank data incident on or about May 31, 2024
- You were sent a notice of the data incident, by postcard or email
- You are a living person residing in the United States
How to file
- Find the Unique ID and PIN printed on your Postcard Notice or Email Notice
- Go to https://finwisedatasettlement.com/Login and log in
- Choose either the Documented Losses Payment or the Cash Fund Payment
- Select "Credit Monitoring" on the form if you want 2 years of free credit monitoring
- If claiming losses, have your documents ready before you start, since the online form does not save your progress
- Submit the form and keep your confirmation email and code
- To file by mail, complete, sign, and date a paper Claim Form and mail it to the Settlement Administrator so it arrives by October 29, 2026
- If you lost your notice or never got one, call 1-877-419-3877 for help

Proof required
- Cash Fund Payment: no documents needed
- Credit Monitoring: no documents needed, just select it on the Claim Form
- Documented Losses Payment: receipts or other records of losses fairly traceable to the data incident
- Self-prepared documents, such as handwritten receipts, are not enough on their own but can support other documents
- Uploaded files must be under 20 MB each and in an accepted format, such as pdf, jpg, png, doc, or xlsx
- You may black out unrelated transactions and all but the first four and last four digits of account numbers
- Unique ID and PIN from your notice are needed to file online
Payment timing
Benefits are sent after the Court grants final approval and the settlement becomes final. The payment method is not listed on the settlement website.

- The total settlement fund is $2,800,000
- Class Counsel will ask for up to 1/3 of the fund in attorneys' fees plus costs, and up to $2,500 each for the Class Representatives
- Credit monitoring is paid first, then documented losses, then cash fund payments from what is left
- If approved documented losses use up the net fund, there will be no cash fund payments, and loss payments will be reduced
- You cannot be paid for expenses already reimbursed by another source, including the identity protection offered in FinWise's notice letter
- The Settlement Administrator may contact you for more documents
- If mailing anything, send it at least a week early, get a manual postmark at a post office, or use Certified Mail
- Do not call the Court or the Court Clerk's office about this settlement
