Class period: The data incident happened in January 2025. Documented out-of-pocket losses must have occurred between January 27, 2025 and September 16, 2026.

  • In January 2025, American Consumer Credit Counseling, Inc. (ACCC) learned that a criminal third party had gained unauthorized access to some of its employee email accounts
  • Files in those accounts may have held names, Social Security numbers, driver's license numbers, financial account numbers, and payment card information
  • The case is Dinkel, et al. v. American Consumer Credit Counseling, Inc., Case No. 2581CV02933, in the Superior Court of Middlesex County, Massachusetts
  • ACCC denies doing anything wrong, and the court has not ruled that it did. Both sides agreed to settle to avoid the cost and risk of a trial
  • Anyone in the United States whose personal information may have been exposed is covered, including everyone who received a notice

  3. Pick one cash category. Category 1 covers documented losses and lost time. Category 2 is the flat $45. You cannot claim both
  4. Attach receipts, bank statements, or other records if you file under Category 1
  5. Claim the three years of credit monitoring on the same form. Filing a valid claim is the only way to get any benefit, including the monitoring

  • The settlement website does not list an exclusion (opt-out) option. If you stay in the class, you give up the right to sue ACCC over this data incident. Section VIII of the Settlement Agreement lists the claims you release

Who is included in this settlement?
Anyone living in the United States whose personal information may have been exposed in the January 2025 ACCC data incident, including everyone who received a notice. ACCC insiders, the judge and their family, and anyone criminally responsible for the incident are excluded.
How much money can I get?
Pick one of two categories. Category 2 pays a flat $45 with no paperwork. Category 1 pays up to $3,500 for documented out-of-pocket losses plus up to $80 for lost time, so up to $3,580 total. Every class member can also claim three years of credit monitoring.
Do I need to send proof?
Only for Category 1. The $45 payment needs nothing at all. Category 1 needs receipts, bank statements, or similar records. So $45 is the price of not digging through a year of bank statements. Only you know if that is a fair trade.
What is the claim deadline?
September 16, 2026. Online claims must be submitted by that date, and mailed claims must be postmarked by that date.
Can I still object or opt out?
No to both. The objection deadline was August 17, 2026 and it has passed. The settlement website does not list an exclusion option at all. You can still file a claim.
What is the credit monitoring worth?
It is three years of CyEx Financial Shield Complete from one bureau, with $1 million in fraud insurance. It watches for identity theft and unauthorized or high-risk financial transactions, and gives you access to a fraud resolution agent.
When will payments go out?
After the court grants final approval and any appeals end. The Final Approval Hearing is October 8, 2026 at 2:00 p.m. Eastern by Zoom. No payment date has been posted.
What happens if I do nothing?
