What happened

Class period: October 4, 2009 through October 8, 2018 (APSN fees); October 4, 2009 through December 31, 2025 (retry fees)

  • South Central Bank, a Kentucky-based financial institution, was sued for charging improper overdraft and non-sufficient funds (NSF) fees on two specific types of transactions
  • The first type -- called APSN fees -- involved signature-based debit card transactions that were authorized when the account had sufficient funds, but then hit with an overdraft fee when the transaction later settled
  • The second type -- called retry fees -- involved overdraft or NSF fees charged on the second or third attempt to process the same transaction after it had already been declined for insufficient funds
  • The lawsuit alleged these practices violated the bank's own account agreements, the duty of good faith and fair dealing, and the Kentucky Consumer Protection Act
  • South Central Bank denied wrongdoing but agreed to a $2,800,000 settlement to resolve the case
  • The settlement received preliminary court approval on March 13, 2026

FAQ

Do I need to file a claim to receive payment?
No. This settlement requires no claim form. The settlement administrator identifies eligible class members directly from South Central Bank's account records and distributes payments automatically.
How is my payment amount calculated?
Your payment is calculated on a pro rata basis -- your share of the net settlement fund is proportional to the total challenged fees you were charged compared to the total charged to all class members combined. There is no cap, but you cannot receive more than the total fees you paid.
How will I receive my payment?
If you still have an open account with South Central Bank, your payment will be credited directly to that account. If you are a former accountholder, you will receive a check by mail. Checks must be cashed within 120 days of issuance or the funds may be redistributed.
What types of fees are covered by this settlement?
Two types are covered. APSN fees are overdraft charges on signature-based debit card transactions that were authorized when your account had enough money but later assessed a fee when the transaction settled -- charged between October 4, 2009, and October 8, 2018. Retry fees are overdraft or NSF charges on a second or third attempt to process a transaction already declined for insufficient funds -- charged between October 4, 2009, and December 31, 2025.
Can I opt out of the settlement?
Yes. You may exclude yourself by submitting a written opt-out request within 30 days of receiving your notice. If you opt out, you will not receive a settlement payment but will retain the right to pursue your own individual legal claim against South Central Bank. Check your notice or the important dates page for your specific deadline.
Can I object to the settlement?
Yes. You may write to the court explaining why you disagree with the settlement terms. Objecting does not remove you from the class -- you will still receive a payment if the settlement is approved. Check https://johnsonoverdraftclassaction.com/important-dates-deadlines.aspx for the objection deadline.
When will payments be sent out?
Payments will be issued only after the court grants final approval of the settlement. The final fairness hearing is scheduled for July 7, 2026. If the settlement is approved and no appeals are filed (or all appeals are resolved), distribution will follow.
What if my address has changed?
Contact the settlement administrator by phone at 888-808-9516 or by email at admin@JohnsonOverdraftClassAction.com to update your mailing address and ensure your check is delivered correctly.
