Bank of America ATM Fee Settlement 2026 -- File a Claim by June 29 if You Banked at 7-Eleven
By eosguide team · Last updated May 15, 2026
Bank of America is paying $2.25M to settle claims it double-charged customers who checked their balance at 7-Eleven ATMs. File by June 29, 2026. Checking your balance cost you twice -- now it could pay you back.
What happened
Class period: May 1, 2018 to November 16, 2021
- Plaintiff Brittany Covell filed a class action lawsuit in the U.S. District Court for the Southern District of California (Case No. 3:19-cv-00264-DMS-MSB) alleging that Bank of America, N.A. (BANA) breached its contract with customers by charging two separate out-of-network (OON) fees for a single balance inquiry at FCTI-owned ATMs located inside 7-Eleven stores.
- In plain terms: customers who simply checked their account balance -- not withdrew money, just checked -- were allegedly billed twice for the same action.
- Bank of America denies all wrongdoing and maintains that assessing two OON balance inquiry fees was proper under its account agreements and applicable law.
- The parties agreed to a $2,250,000 Settlement Fund to resolve the case.
- The class period runs from May 1, 2018 to November 16, 2021.
- Former (past) accountholders must file a claim by June 29, 2026. Current Bank of America accountholders who received a notice do not need to file -- they will be paid automatically if the settlement is approved.

Extra details
- There are two separate tracks: current Bank of America accountholders who received a notice are paid automatically; former accountholders must file a claim or they receive nothing
- The settlement website contains a discrepancy: the rights-and-options table on the homepage lists the claim deadline as July 29, 2026, while the Important Dates section and FAQ both say June 29, 2026. June 29 is a Monday and is almost certainly correct, but confirm at oonfeesettlement.com before filing
- If your address has changed, update it with the administrator using the Contact Us form at oonfeesettlement.com or by mail to ensure your payment reaches you
- Anyone who already received payment in Weiss v. FCTI, Inc. is not eligible for this settlement
- Watch for scams: oonfeesettlement.com is the only court-authorized website for this case
