What happened

Class period: November 1, 2016 through February 28, 2019

  • Flo Health runs the Flo App, a period and ovulation tracker used to log menstrual cycles and pregnancy
  • The lawsuit, Frasco v. Flo Health Inc., claims that between November 1, 2016 and February 28, 2019, Flo built software development kits (SDKs) from Flurry, Meta (Facebook), and Google into the app
  • Through those SDKs, the app allegedly shared users' menstruation and pregnancy information with those companies without permission
  • Flo, Google, and Flurry deny any wrongdoing, and the Court did not rule on the claims. They settled to end the litigation
  • Google agreed to pay $48 million, Flo $8 million, and Flurry $3.5 million, for a total fund of $59.5 million
  • A separate trial against Meta ended August 1, 2025 with a jury verdict for the plaintiffs. If you are owed money from that verdict, you will be contacted later. Filing a claim in these settlements does not affect your Meta verdict rights

This settlement may pay eligible claimants for what happened here — worth filing. But data brokers are a separate, ongoing problem — hundreds of companies collect and sell your personal information continuously, from public records, loyalty programs, and more. They don’t need a hack to get it. Incogni sends removal requests to 420+ data brokers on your behalf and continues checking for reappearing data.

FAQ

Who qualifies for the Flo App settlement?
Anyone who used the Flo App in the United States between November 1, 2016 and February 28, 2019 and entered menstruation or pregnancy information into the app. There is also a California Subclass for people who did this while living in California.
How much money will I get?
There is no fixed amount. The $59.5 million fund is split pro rata among everyone who files a valid claim, after fees and costs. Fewer claims means bigger checks, but do not count on your neighbors forgetting to file.
Do I need proof to file?
No. You just confirm on the Claim Form that you used the app and entered cycle or pregnancy information during the class period. No screenshots of your 2017 app history required.
What is the deadline to file?
October 15, 2026. Online claims are due by 11:59 p.m. Pacific Time, and mailed claims must be postmarked by that date.
What about the Meta verdict?
Meta went to trial instead of settling, and the jury ruled for the plaintiffs on August 1, 2025. That money is handled separately. If you are eligible, you will be contacted later, and filing a claim in these settlements does not affect it.
Can I opt out?
No. The exclusion deadline was July 20, 2025 and has passed. Your options now are to file a claim, object by October 8, 2026, or do nothing and get no payment.
