What happened

  • A class action called In re Chantix (Varenicline) Mktg., Sales Pracs. and Prods. Liab. Litig. (No. II) was filed against Pfizer, Inc. in the U.S. District Court for the Southern District of New York (Case Nos. 22-MD-3050 and 22-MC-3050), before Judge Katherine Polk Failla
  • Chantix is Pfizer's brand-name prescription drug for quitting smoking
  • Plaintiffs claimed Pfizer did not follow current good manufacturing practices, and that this left Chantix contaminated with a nitrosamine that was never disclosed to buyers
  • The Court narrowed the case to consumer protection claims plus certain unjust enrichment and negligent misrepresentation claims, all tied to Pfizer's statements about following good manufacturing practices
  • Pfizer denies doing anything wrong and says it settled to avoid the cost and risk of a trial
  • Pfizer agreed to pay $44,000,000. The case covers money people paid for the drug, not health effects
  • It affects anyone in the United States and its territories who paid any amount for retail purchases of Chantix from September 29, 2015 through September 17, 2021

FAQ

Who qualifies for the Chantix settlement?
Anyone who paid any amount for retail purchases of Chantix in the United States or its territories between September 29, 2015 and September 17, 2021. Health plans and insurers that paid for it also qualify, through a separate claim form.
How much money will I get?
There is no flat amount. Consumers share up to 20 percent of the fund after fees and costs, split based on how much each person paid. Your payment cannot exceed what you actually spent on Chantix.
Why do consumers only get 20 percent of $44 million?
The rest goes to third-party payors, meaning the insurers and health plans that covered most of the cost of each prescription. They paid the bigger share, so they claim the bigger share.
Do I need receipts?
Not to file, but they help. The claim form asks how much you paid, and you should attach records if you have them. The administrator can request more documentation later and can reject a claim if you do not provide it.
I do not have my pharmacy records. What can I do?
Most pharmacies can print a payment history going back several years, often at no cost. Your insurer's prescription history can work too.
What was wrong with Chantix?
The lawsuit claims Pfizer did not follow good manufacturing practices, which left the drug contaminated with a nitrosamine that buyers were never told about. Pfizer denies this.
Does this settlement cover health problems I had?
This case is about money paid for the drug, and the Court narrowed it to consumer protection and related claims. If you are thinking about other kinds of claims, talk to Class Counsel for free at 212-223-6444 or to your own lawyer before the September 14 deadline.
What is the deadline?
September 14, 2026. That is the deadline to file, to opt out, and to object, which makes it an easy date to remember and an easy one to miss.
When will I get paid?
The Court decides on October 13, 2026. Payments come after that, once any appeals are resolved and all claims are processed. No date has been announced.
Is this settlement real?
Yes. It is In re Chantix (Varenicline) Mktg., Sales Pracs. and Prods. Liab. Litig. (No. II), Case Nos. 22-MD-3050 and 22-MC-3050, in the U.S. District Court for the Southern District of New York. A.B. Data, Ltd. is the claims administrator.
