What happened

Class period: Pools sold from 2008 through 2024, purchased on or before May 4, 2026

  • Bestway (USA) Inc., Bestway Inflatables & Material Corp., and Bestway (Hong Kong) International Ltd. agreed to a $15,000,000 settlement in a class action called In re Bestway Above-Ground Pools Litigation (Case No. 1:25-cv-09570, U.S. District Court for the Northern District of Illinois)
  • The lawsuit claims Bestway-branded above-ground pools sold from 2008 through 2024 that are 48 inches or taller, with compression straps running on the outside of the vertical support legs, create a potential drowning hazard
  • Affected models include Power Steel, Steel Pro, and Coleman Power Steel pools
  • Bestway issued a voluntary recall with the U.S. Consumer Product Safety Commission on July 21, 2025. The complaint says the recall was inadequate because it offered no money

Proof required

  • No proof needed for the flat $40 payment. You only need to complete and sign the Claim Form under attestation
  • For the 10% payment, you need Valid Proof of Purchase showing you bought a Class Product on or before May 4, 2026

How much money can I get?
A flat $40 if you do not have a receipt. If you have valid proof of purchase, you get 10% of the price you paid. If your receipt does not show a price, you get 10% of the Average Retail Price for your pool model.
What is the deadline to file?
October 30, 2026. Online claims must be in by 11:59 p.m. Central Time. Mailed claims must be postmarked by that date.
Do I need a receipt?
Not for the $40. You just sign the claim form under attestation. A receipt or other verifiable record of purchase only matters if you want the 10% payment instead.
Is 10% of the price better than $40?
Only if you paid more than $400 for the pool. Below that, the flat $40 is the bigger check, and it needs no paperwork at all.
I bought two pools. Can I file two claims?
No. Only one claim is allowed per household, which means everyone living at the same address.
I already took part in the recall. Can I still file?
Yes. The settlement is separate from the July 2025 recall. You do not have to join the recall to file a claim, and filing a claim does not take away any recall rights.
