What happened
Class period: Pools sold from 2008 through 2024, purchased on or before May 4, 2026
- Bestway (USA) Inc., Bestway Inflatables & Material Corp., and Bestway (Hong Kong) International Ltd. agreed to a $15,000,000 settlement in a class action called In re Bestway Above-Ground Pools Litigation (Case No. 1:25-cv-09570, U.S. District Court for the Northern District of Illinois)
- The lawsuit claims Bestway-branded above-ground pools sold from 2008 through 2024 that are 48 inches or taller, with compression straps running on the outside of the vertical support legs, create a potential drowning hazard
- Affected models include Power Steel, Steel Pro, and Coleman Power Steel pools
- Bestway issued a voluntary recall with the U.S. Consumer Product Safety Commission on July 21, 2025. The complaint says the recall was inadequate because it offered no money
- The settlement does not release claims for personal injury, wrongful death, or property damage, and it does not limit any rights under the recall
- Bestway denies the pools are defective and denies any wrongdoing. The court has not decided who is right

Who may qualify
- You live in the United States, its territories, or the District of Columbia
- You bought a Bestway-branded above-ground pool 48 inches or taller, including Power Steel, Steel Pro, and Coleman Power Steel models
- The pool has compression straps located on the outside of the vertical support legs
- The pool was sold between 2008 and 2024, and you bought it on or before May 4, 2026
- You bought it new from a retailer for personal use, not for resale and not second-hand
- You are not a Bestway employee, retailer, distributor, judge on the case, or Class Counsel
How to file
- Go to poolsettlementbw.pnclassaction.com
- Choose whether you have a Settlement Claim ID from a notice or are filing without one, then click "Begin Claim"
- Enter your contact information and pool details
- Upload a receipt or other proof of purchase if you have one, or skip it to claim the flat $40
- Pick an electronic payment option or a paper check
- Sign the form under attestation and submit by 11:59 p.m. CT on October 30, 2026
- To file by mail, download the Claim Form from the Court Documents page, or call 1-855-789-5948 to request one, and mail it postmarked by October 30, 2026 to Bestway Settlement Administrator, P.O. Box 1869, Baton Rouge, LA 70821

Proof required
- No proof needed for the flat $40 payment. You only need to complete and sign the Claim Form under attestation
- For the 10% payment, you need Valid Proof of Purchase showing you bought a Class Product on or before May 4, 2026
- Examples include store receipts, online order receipts, or any other record of purchase made at the time that can be objectively verified
- If your proof does not show the price paid, the payment is 10% of the Average Retail Price for that pool model
- All proof is subject to verification by the Settlement Administrator
- Only one claim is allowed per household, meaning everyone sharing the same residential address
Payment timing
Payments go out after the court grants final approval and any appeals are resolved. The Fairness Hearing is set for November 20, 2026. You can choose from several electronic payment options or a paper check mailed to the address on your Claim Form.

- Opt-out requests can be submitted online at poolsettlementbw.pnclassaction.com/Exclusion by 11:59 p.m. CT on October 30, 2026, or mailed postmarked by that date. If you opt out, you get no payment but keep the right to sue on your own
- Objections must be filed with the court through ECF or delivered to the Clerk of the Court, Dirksen U.S. Courthouse, ATTN: Bestway Settlement Objections, 219 S. Dearborn Street, Chicago, IL 60604, by October 30, 2026. You can object and still file a claim
- Class Counsel may ask for attorneys' fees of up to one-third of the settlement fund plus costs, and $2,500 service awards for each of the eight class representatives
- The Fairness Hearing is before Judge Lindsey C. Jenkins at 219 South Dearborn Street, Courtroom 2119, Chicago, IL 60604. The court may hold it in person, by Zoom, or by phone, and the date may change. Check the official site
