Up to $25,000 Americold Data Breach Settlement: How to Claim

What happened

Class period: Data incidents on or about November 16, 2020 and April 26, 2023

• Americold Realty Trust and Americold Logistics, LLC agreed to a $5,250,000 settlement in a class action called Lamont Bracy, et al. v. Americold Logistics, LLC (Case No. 1:23-cv-05743-TWT, U.S. District Court for the Northern District of Georgia)
• The lawsuit covers two separate cybersecurity incidents: one on or about November 16, 2020 and one on or about April 26, 2023
• Both incidents allowed unauthorized access to personal information and protected health information of current and former employees and job applicants
• The exposed data may have included full names, Social Security numbers, addresses, driver's license numbers, state ID numbers, passport numbers, financial account information, health insurance information, and medical information
• Americold sent notices about the 2020 incident starting around March 4, 2021 and about the 2023 incident starting around December 8, 2023
• Plaintiffs claim Americold failed to properly secure this information. Americold denies all wrongdoing, and the court has not ruled on who is right

• You live in the United States
• Americold notified you that your Private Information was impacted in the 2020 Data Incident, the 2023 Data Incident, or both
• You are a current or former Americold employee or a job applicant whose data was involved
• You are not an Americold officer, director, or affiliate, and not a judge assigned to the case

How to file

1. Go to the official settlement website at americoldbracysettlement.com
2. Click "Submit Claim" and complete the online Claim Form
3. Choose the Residual Cash Payment, the Documented Losses Payment, or both
4. Check the box to add three years of Credit Monitoring if you want it
5. Upload documents only if you are claiming Documented Losses
6. Submit online by October 22, 2026, or mail a paper form to Lamont Bracy v. Americold Logistics, LLC, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391, postmarked by October 22, 2026

Proof required

• Residual Cash Payment: no documents needed. The administrator uses Americold's notice records to confirm you are a class member and whether you were notified of one incident or both
• Credit Monitoring: no documents needed
• Documented Losses Payment: reasonable documentation required, such as receipts, phone records, or correspondence including emails
• Covered losses include long-distance phone charges, per-minute cell or internet charges, credit report costs, credit monitoring or fraud resolution costs, and expenses tied to identity theft related to the breaches
• Personal statements, declarations, or affidavits alone do not count as documentation, but you can include them to explain your other records
• Losses already reimbursed by another source, including the free credit monitoring Americold offered in its notice letter, cannot be claimed again
• If your Documented Losses claim is rejected and not fixed, it becomes a Residual Cash Payment claim

Payment timing

Payments go out after the court grants final approval and any appeals are resolved. The final approval hearing is set for October 6, 2026. Credit monitoring enrollment codes will be emailed to class members who chose that benefit after approval.

• All cash payments may go up or down pro rata depending on how many valid claims are filed and how much money is left in the fund after fees, costs, and credit monitoring
• Class members notified of both incidents receive double the Residual Cash Payment of those notified of only one
• Class Counsel will ask for attorneys' fees of up to 35% of the fund ($1,837,500) plus expenses, and $3,000 service awards for each of the seven class representatives
• Opt-out requests must be mailed and postmarked by September 22, 2026. If you opt out, you get no benefits but keep the right to sue on your own
• Objections must be filed with the court and mailed to Class Counsel, Defendant's Counsel, and the administrator, postmarked by September 22, 2026. You can object and still file a claim
• The final approval hearing is at the Richard B. Russell Federal Building, 75 Ted Turner Drive SW, Courtroom 2108, Atlanta, GA 30303. The date may change without notice, so check the official site
• Americold says it has taken steps to further secure its systems
• Watch for scams: americoldbracysettlement.com is the only authorized website for this case
