What happened

Class period: May 27, 2023 through May 31, 2023 (the MOVEit Security Incident dates)

  • Between May 27 and May 31, 2023, cybercriminals exploited a vulnerability in MOVEit Transfer -- a third-party file transfer software used by Union Bank and Trust Company (UBT) -- and gained unauthorized access to the personally identifiable information (PII) of UBT clients.
  • The breach was part of a widespread MOVEit attack affecting many organizations. Plaintiffs filed class action lawsuits alleging UBT was negligent in its data security practices.
  • UBT denies any wrongdoing but agreed to settle to avoid the cost and uncertainty of trial. Claims against Progress Software Corporation, the maker of MOVEit, are continuing separately and are not resolved by this settlement.
  • Anyone in the United States whose PII was included in the files affected by the breach -- and who received a notice from UBT -- is a potential class member.

  • The $100 alternative cash payment may increase up to $1,000 if total valid claims do not exhaust the Net Settlement Fund -- so filing sooner rather than later is a reasonable idea.
