What happened

Class period: June 10, 2021 through September 18, 2025

• Luis Boggiano and other plaintiffs sued Mount Sinai Medical Center of Florida a/k/a Mount Sinai Medical Center in the Circuit Court of the 17th Judicial Circuit in and for Broward County, Florida, Case No. CACE-26-006904-09
• The lawsuit claims that tracking, analytics, and advertising technologies on the Mount Sinai website and patient portal disclosed personally identifying information, Protected Health Information, and confidential communications to third parties
• Protected Health Information means individually identifiable information about a person's past, present, or future health status that is created, collected, transmitted, or maintained by a HIPAA-covered entity, as defined under HIPAA (42 U.S.C. section 1320d)
• The disclosures are alleged to have happened between June 10, 2021 and September 18, 2025
• Mount Sinai denies any wrongdoing or liability, and the Court has not decided that any law was broken. Both sides agreed to settle to avoid the risk, cost, and time of continuing the lawsuit
• The Settlement Class includes all living individuals who accessed the Mount Sinai website or patient portal during that period

• You are not an officer, director, or employee of Mount Sinai Medical Center of Florida
• You are not the judge presiding over the case, a member of the judge's immediate family, or judicial staff
• You are not a governmental entity
• You did not timely and validly opt out of the Settlement

How to file

1. Go to the official settlement website at mountsinaidatasettlement.com
2. Click the claim form login link and submit the online Claim Form by September 28, 2026
3. Or download a paper Claim Form from the settlement documents page, or request one by calling 1-800-485-1017
4. Mail paper forms postmarked by September 28, 2026 to Mt. Sinai Data Disclosure Settlement Administrator, PO Box 64053, St. Paul, MN 55164
5. You do not need to file a Claim Form to get the free year of Medical Data Monitoring
6. If your mailing or email address changes after you file, write to the Settlement Administrator or email MountSinaiDataSettlement@AtticusAdmin.com

Proof required

• No supporting documents are required to receive the Cash Payment
• Complete and submit a timely and valid Claim Form by the deadline
• For Medical Data Monitoring, use the activation code printed on your Settlement Notice

Payment timing

Payments are sent after the Court approves the Settlement and it becomes final. The Final Approval Hearing is set for October 13, 2026. The official site does not list a payment method -- check mountsinaidatasettlement.com for updates.

• The Cash Payments come from a fixed Total Cash Payment of $220,000, so the estimated $20 can go up or down pro rata depending on how many valid claims are filed
• Medical Data Monitoring is free for one year and requires no Claim Form, but you do need the activation code from your Settlement Notice, which works only after final approval
• If you do nothing, you get no Cash Payment, you still get the Medical Data Monitoring code, and you give up your right to sue over these claims
• To opt out, mail a signed written request postmarked by September 14, 2026. You cannot opt out by phone or email
• To object, file with the Court and serve Class Counsel, Defendant's Counsel, and the Settlement Administrator by September 14, 2026. Objections must state whether artificial intelligence was used to prepare them
• Class Counsel will ask the Court for attorneys' fees and costs up to $500,000 and Service Awards up to $2,500 for each Class Representative, paid separately by Mount Sinai
• The Final Approval Hearing date and time can change without further notice, and the Court may hold it by video or phone
