- A class action called Brynn Grossman et al. v. Night US, LLC and Brooklyn Bedding LLC was filed in the Superior Court of California, County of San Diego (Case No. 26CU017232N)
- The lawsuit claims the companies deceptively advertised discounts on four mattress websites: leesa.com, brooklynbedding.com, helixsleep.com, and bearmattress.com
- It claims this broke California consumer protection laws, and adds claims for breach of contract, breach of express warranty, unjust enrichment, and misrepresentation
- The companies deny all of it and say their advertising was lawful the whole time. They settled to avoid the cost and risk of a trial

- You are not a government entity, a lawyer of record in the case, the presiding judge, a company officer or director, or an immediate family member of one

Payment timing
Awards go out only after the Court approves the settlement at the October 16, 2026 hearing and any appeals are resolved, which the notice warns can take more than a year. Cash Benefits come by check or electronic payment. Credit Vouchers stay valid for three years from the date they are issued.

- This is a rare settlement where doing nothing still pays. You get a $110 Credit Voucher per mattress automatically. Cash requires the form
- Credit Vouchers only work on the site you bought from. Two mattresses from two different sites means two vouchers that cannot be combined
- Vouchers can be stacked with other sales and discounts, transferred to someone else, and used against shipping, taxes, and fees. No blackout dates
- Attorney fees up to $1,900,000, admin costs up to $40,000, and incentive awards up to $5,000 each are paid separately by the companies. They do not reduce your $110
- If you object to the settlement, you still stay in the class and still get your award
