Flagstar Bank Data Breach Settlement 2026 -- File a Claim by August 11
By eosguide editorial · Last updated
Flagstar Bank's 2021 data breaches exposed 2.19 million people. File a claim by August 11, 2026 for up to $25,000 or free credit monitoring. Two breaches in a single year from a company built to guard your money -- the cleanup is on them this time.
What happened
Class period: There is no traditional purchase-based class period. Eligibility is based on being one of the roughly 2,187,170 individuals Flagstar identified as impacted by the January 2021 and December 2021 Data Breaches.
- Flagstar Bank was hit by two separate cyberattacks in 2021. In January 2021, criminals broke into a file sharing platform Flagstar used and accessed the personal information of about 1.47 million people. In December 2021, a second attack infiltrated Flagstar's network and exposed the data of roughly 1.58 million people.
- Together the two Data Breaches impacted the personally identifiable information of approximately 2,187,170 U.S. consumers, including about 364,000 California residents.
- A class action followed, claiming Flagstar failed to adequately protect customer data and was slow to give notice. Flagstar denies any wrongdoing, and no court has found it liable. Both sides agreed to settle rather than go to trial.

Proof required
- No documents are required for the residual cash payment, credit monitoring, or California statutory payment
- For Documented Monetary Losses, submit receipts or other records not self-prepared by you that show the costs incurred
- Handwritten or self-prepared receipts alone are not enough, but may help support other documentation
- California residents claiming the statutory payment must attest under penalty of perjury that they lived in California at the time of the breaches
Payment timing
Payments will be distributed after the Court grants final approval at the October 1, 2026 hearing and any appeals are resolved, which can take time. Payment method options are selected on the Claim Form -- check the official site for details.

Extra details
- The tear-off Claim Form mailed to you works for the residual cash payment, credit monitoring, and California payment, but not for Documented Monetary Loss claims, which need full documentation
- Benefits may be reduced pro rata if total valid claims exceed the $31.5 million Settlement Fund, though Class Counsel do not expect that
- Class Counsel are John Yanchunis of Morgan & Morgan and Norman Siegel of Stueve Siegel Hanson
- Use only the official site to file. Other sites may carry incorrect information, and a data breach settlement is exactly the kind of thing scammers like to imitate
