$23.9M Costa Sunglasses Repair Settlement: No Claim Needed

What happened

Class period: April 3, 2015 through January 28, 2026 (repair fee dates). Sunglasses must have been bought before January 1, 2018.

• A class action called Reed v. Costa Del Mar, Inc., Case No. 6:19-cv-1751, is in the U.S. District Court for the Middle District of Florida
• Boxes of non-prescription, non-promotional Costa sunglasses said Costa would replace scratched lenses, frames, and other parts damaged by accident, normal wear and tear, or misuse for a "nominal fee"
• The lawsuit claims Costa charged more than a nominal fee for these repairs
• It also claims Costa did not tell customers the repair charges at the store, on its website, or by phone before they mailed in their sunglasses at their own cost
• The case was brought under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). Costa performed about 494,000 repairs during the class period
• The Plaintiff argued a nominal fee is at most $11.95. The Court has not decided what counts as nominal
• Costa denies all wrongdoing. It says the box language was marketing, not a promise, and that its fees were nominal
• Both sides agreed to a $23,900,000 settlement to avoid the risk, cost, and time of more litigation

• You bought non-prescription, non-promotional Costa sunglasses before January 1, 2018
• Costa charged you a fee between April 3, 2015 and January 28, 2026 to repair or replace parts damaged by accident, normal wear and tear, or misuse
• Your repair fee was more than $11.95
• Florida residents are covered by a separate case, Haney v. Costa Del Mar, Inc.
• Costa, its controlled affiliates, certain related persons, and judicial staff on the case are excluded

1. No claim form is needed. Eligible class members get paid automatically
2. To choose how you get paid, go to the official site and click "Submit Payment Selection"
3. Enter the Unique ID and PIN from your email or postcard notice
4. Pick your payment method and submit

Payment timing

Payments are sent automatically after the Court approves the settlement and it becomes final. You can pick a payment method using the Unique ID and PIN in your email or postcard notice. The Final Approval Hearing is December 14, 2026.

• Attorney fees and costs (Class Counsel is asking for $5,736,000) and administration costs are paid from the $23.9 million fund before payments are figured
• Any money left over goes to the American Saltwater Guides Association, if the Court approves
• If you got a notice in 2025, that was about the case becoming a class action. The new notice is about the settlement
• If you got a notice about Smith v. Costa Del Mar, Inc., that settlement was vacated and is no longer in effect
• To opt out, mail a signed request so it is received by October 26, 2026. You cannot opt out by phone or email, and if you opt out, you get no payment
