Cash Payment: Costa Sunglasses Repair Fee Settlement (Florida)

What happened

Class period: Purchase Class: July 28, 2013 through January 31, 2018. Repair Class: July 28, 2012 through January 26, 2025.

• Costa Del Mar sold sunglasses with packaging that promised to replace scratched lenses, frames, and other parts for a "nominal fee" if the sunglasses were damaged by accident, normal wear and tear, or misuse
• The lawsuit claims Costa charged more than a nominal fee for these repairs
• It also claims Costa did not disclose repair charges before customers mailed in their sunglasses at their own expense
• The claims were brought under the Florida Deceptive and Unfair Trade Practices Act and the federal Magnuson-Moss Warranty Act
• Costa denies all wrongdoing but agreed to create a $21,750,000 settlement fund

Who may qualify

• You are a citizen of the State of Florida
• Purchase Class: you bought non-prescription, non-promotional Costa sunglasses for personal use between July 28, 2013 and January 31, 2018
• Repair Class: you bought those sunglasses on or before January 31, 2018 and were charged a fee by Costa between July 28, 2012 and January 26, 2025 to replace damaged parts
• Repair payments apply only to repairs that cost more than $11.95
• If you are in both classes, you take part only as a Repair Class Member and cannot file a claim form
• You are not Costa, a Costa-controlled entity, its employees, officers, or directors, or the judge or judge's staff

How to file

1. Only Purchase Class Members file a claim; Repair Class Members are paid automatically
2. Go to the official claim page and click "Start Your Claim"
3. Submit your claim online by January 11, 2027
4. Or download a claim form and mail it, postmarked by January 11, 2027, to Haney v Costa Del Mar, Inc., Settlement Administrator, PO Box 4153, Portland, OR 97208-4153
5. If mailing, send it at least a week early, get a manual postmark at a post office, or use Certified Mail
6. If you are in both classes, do not file a claim form

Proof required

• Purchase Class: no supporting documents are listed as required for up to five qualifying purchases
• Purchase Class: supporting documentation may be required to get paid for more than five qualifying purchases
• Repair Class: no claim form or proof needed; payment is automatic

Payment timing

Cash payments will be sent after the Court approves the settlement and it becomes final. Check the settlement website for updates.

• $6,375,000 of the fund goes to the Purchase Class; the rest goes to the Repair Class after administration costs and attorneys' fees and expenses
• Class Counsel will ask for $7,303,605 in attorneys' fees and expenses from the fund
• Any money left over will go to Captains for Clean Water, subject to Court approval
