What happened

Class period: January 1, 2015 through April 10, 2024 for having a Patient Portal account. January 1, 2015 through July 31, 2019 for the higher Group 1 payment.

  • Atrium Health used pixel technology on its public website and, from January 1, 2015 to July 31, 2019, inside its MyAtriumHealth and MyCarolinas patient portals
  • A pixel is a small piece of tracking code that reports what a visitor does on a page back to a third party
  • The lawsuit says that code sent personal and health-related information to outside companies, including Meta (formerly Facebook) and Google
  • Plaintiffs say this invaded the privacy of patients who used those portals
  • Atrium Health denies that using the technology creates any legal claim and denies wrongdoing. The Court has not decided who is right

  • For the larger Group 1 payment, you also accessed or used that account between January 1, 2015 and July 31, 2019
  • You are not Atrium Health, an entity it controls, or one of its affiliates, parents, subsidiaries, officers, directors, or legal representatives
  • You are not a judge or judicial officer on the case, or a member of their immediate family or judicial staff
  • You did not exclude yourself from the Settlement Class

Extra details

  • You cannot get both payments. Qualifying for Group 1 rules out Group 2
  • Group 1 payments are not a set amount. Attorney fees of up to $500,000, expenses up to $25,000, $2,500 for each of the four class representatives, and Group 1 administration costs come out of the $1,500,000 fund first. What is left is split evenly among people who file
  • Group 2 payments are capped at $10 and can be less, since that pool is a separate $300,000 shared by everyone who qualifies

  • To keep your right to sue Atrium Health on your own, mail a Request for Exclusion postmarked by August 31, 2026. If you opt out, you get no payment
  • If you do nothing, you get no payment and you still give up the right to sue over the claims this settlement covers

What is a tracking pixel?
It is a small piece of code on a web page that reports what you did there to an outside company. It works quietly in the background, which is the whole point of it and also the whole problem with putting one in a patient portal.
How much money will I get?
It depends on which group you land in. If you used your portal between January 1, 2015 and July 31, 2019, you share a $1,500,000 fund after fees and costs come out, so the exact amount depends on how many people file. If you had an account but did not use it in that window, you get up to $10 from a separate $300,000 pool.
Can I get both payments?
No. If you qualify for a Group 1 payment, you are not eligible for a Group 2 payment.
Do I need proof or records?
No. You attest on the claim form, and the administrator checks it against Atrium Health's records. The company that tracked your visits is the same company confirming you visited.
What is the deadline?
September 28, 2026. Online claims must be submitted by that date and mailed claims must be postmarked by that date.
What if I want to sue Atrium Health myself?
Mail a written Request for Exclusion, postmarked by August 31, 2026, to Kroll Settlement Administration. You give up any settlement payment if you do.
When will payments be sent?
Not until after the final approval hearing on September 30, 2026, and after any appeals are finished. There is no published payment date yet.
What happens if I do nothing?
You get nothing and you still lose the right to sue Atrium Health over the claims this settlement resolves. Doing nothing is the only option here that costs you something.
