Who qualifies for this settlement?
You qualify if you reside in the United States and TRISTAR Insurance Group sent you a Notice of Data Incident on or around February 1, 2024, indicating that your personally identifiable information may have been compromised in the November 2022 data breach. If you received a notice, you are eligible to file a claim.
What benefits can I receive?
You can choose between two tracks. The first track allows you to claim reimbursement for documented out-of-pocket expenses (up to $500), lost time spent dealing with the breach (up to $100), and -- if you suffered identity theft or fraud -- an extraordinary loss payment of up to $5,000. The second track is a no-documentation alternative cash payment: $40 for most class members, or $100 if you are in the California subclass. All class members are also eligible to enroll in three years of triple bureau credit monitoring, regardless of which payment option they select.
What is the deadline to file?
July 15, 2026. Claims must be submitted online or mailed with a postmark no later than that date.
Do I need documents to file?
It depends on what you are claiming. The alternative cash payment ($40 or $100) requires no documentation -- just a completed claim form. Lost time claims require an attestation under penalty of perjury. Out-of-pocket expense and extraordinary loss claims require third-party documentation such as receipts or other records; self-prepared documents alone are not sufficient.
How much will I actually receive?
Cash payments are subject to a $1,000,000 aggregate cap across all class members. If total approved claims exceed that cap, individual payments will be reduced proportionally. If you are filing a no-documentation alternative cash payment claim, your payout is either $40 (non-California) or $100 (California), subject to pro rata reduction if the cap is exceeded.
What is the deadline to opt out or object?
Both the opt-out (exclusion) deadline and the objection deadline are June 15, 2026. To exclude yourself, mail a written request to Tristar Data Settlement, PO Box 1908, Baton Rouge, LA 70821, postmarked by that date. To object, file a written objection with the Tulsa County District Court and mail copies to class counsel and TRISTAR's counsel, also postmarked by June 15, 2026.
What if I do nothing?
You will not receive any payment or credit monitoring. If the court approves the settlement, you will still release your legal claims against TRISTAR related to the data breach -- without getting anything in return. Filing a claim is the only way to receive benefits.
