What happened

Class period: April 14, 2017 through April 1, 2023

  • Plaintiffs alleged that Travelers Indemnity Company and related entities wrongfully reduced Personal Injury Protection (PIP) coverage limits by applying PIP deductibles and copayments to reduce the total PIP benefits available -- meaning insureds who had paid for a certain level of coverage were not paid the full amount they were owed
  • The lawsuit covers New Jersey automobile insurance policyholders who were paid PIP benefits within $3,000 of their policy limit but never reached the full limit during the class period
  • A related lawsuit brought by Courtney Thorson and Michael J. Lucci, Jr. against The Travelers Companies and St. Paul Protective Insurance Co. has been consolidated into this settlement
  • Travelers denies all allegations of wrongdoing and liability
  • The settlement provides an automatic $70 payment to all class members who do not opt out, plus the opportunity to file a claim for up to 80% of any shortfall between what was paid and the full policy limit

FAQ

What is this lawsuit about?
Plaintiffs alleged that Travelers wrongfully reduced Personal Injury Protection (PIP) coverage limits on New Jersey automobile insurance policies by applying deductibles and copayments to reduce the total benefits available. This meant some policyholders were paid less than their full PIP policy limit. Travelers denies all wrongdoing.
Who qualifies for this settlement?
You may qualify if you were a policyholder or insured under a New Jersey automobile insurance policy issued by Travelers with PIP coverage, Travelers made a final PIP payment to you between April 14, 2017, and April 1, 2023, and the amount you were paid was within $3,000 of your policy limit but less than the full limit.
Do I have to do anything to get the $70 payment?
No. If you are a class member and did not opt out of the settlement, you will automatically receive a $70 check. You do not need to submit a claim form to receive it. You must cash the check within 120 days of the issuance date or you will not receive any money from the settlement.
How do I get more than $70?
Submit a Claim Form by June 16, 2026. Travelers will review your PIP claim file to determine if your policy limit was improperly reduced by deductibles or copayments. If a reduction is confirmed, you may receive 80% of the difference between your PIP policy limit and the amount you were actually paid, minus the $70 automatic payment.
What if Travelers says I am not owed anything?
You can appeal the determination to a Neutral Evaluator at no upfront cost. If your appeal is successful, there is no charge. If your appeal is unsuccessful, you will be responsible for $70 toward the Neutral Evaluator's fee. The Neutral Evaluator's decision is final and cannot be further appealed.
How do I submit a claim?
File online at njpipsettlement.com/Login using the Unique ID and PIN from your notice, or download a claim form from the Documents page and mail it to: Thompson, Thorson, and Lucci v. Travelers, c/o Settlement Administrator, P.O. Box 5770, Portland, OR 97228-5770. Claims must be submitted online or postmarked by June 16, 2026.
What is the claim deadline?
June 16, 2026. Claims must be received online or postmarked by that date.
When will I get paid?
