American Express Antitrust Settlement 2026 – Illinois Non-Rewards Card Holders File by May 19

American Express is settling a class action antitrust lawsuit alleging its anti-steering rules forced merchants to raise prices for everyone — including customers who never touched an Amex card. If you used a non-rewards Visa, Mastercard, or Discover credit card to make in-person purchases in Illinois between 2016 and 2022, you may be entitled to a payment from a $17.5 million settlement fund. File by May 19, 2026.

Benefit American Express had rules in its merchant agreements that prevented merchants from "steering" customers toward other payment methods — meaning a merchant could not tell you that paying with your Visa might save them money, even if it would have. The lawsuit alleged that these anti-steering rules gave Amex cover to charge merchants higher fees, and that merchants responded by raising prices across the board to cover those fees. The result: customers who never owned an Amex card ended up subsidizing the ones who did. The case went all the way to trial, a jury returned a verdict, and a settlement followed. American Express denies any wrongdoing. A $17.5 million settlement fund is now available to eligible class members. Currently, only the Illinois non-rewards credit card class can file a monetary claim.

FAQ

I shopped in Illinois with my non-rewards Visa or Mastercard during 2016 to 2022. Does that automatically qualify me?
Mostly yes, with a few catches. Your billing address must also have been in Illinois at the time of the purchase, the purchase must have been made in person at a Qualifying Merchant (not online), and you must not have held an American Express card at any point during the class period. Check the full Qualifying Merchants list in the FAQs at amexantitrust.com.
Why do I have to not have an Amex card to qualify?
The lawsuit was filed on behalf of people who paid inflated prices because of Amex's rules but had no Amex card and therefore received none of Amex's perks in return. If you had an Amex card, you were on the other side of that equation.
I have a rewards credit card. Can I still file?
No. This settlement is specifically limited to non-rewards, no annual fee Visa, Mastercard, or Discover cards. Rewards cards are excluded regardless of which state you are in.
How will I receive my payment?
Digitally only. The Settlement Administrator will email or text you when your payment is ready, and you will choose from options including PayPal, Amazon credit, or a virtual debit card. There is no paper check option, so a valid email address and mobile number on your claim form are essential.
What if I do not have documentation of my purchases from 2016 to 2022?
You do not need to submit documentation with your claim form. You simply attest that you meet the eligibility criteria. The Administrator may request supporting documents during review, so it is worth checking whether you can locate old credit card statements — but do not let the absence of records stop you from filing.
