What happened

Class period: December 29, 2014 through March 18, 2022 (Property and Casualty Insurance Company of Hartford) January 1, 2019 through March 18, 2022 (Hartford Insurance Company of the Midwest)

Underinsured motorist coverage — UIM — exists to protect you when the at-fault driver's insurance isn't enough to cover your damages. Hartford allegedly sold New Mexico drivers this coverage and then applied an offset equal to the at-fault driver's liability payout, which could partially or completely cancel out the UIM benefits policyholders had paid for.

A class action lawsuit alleged this made the UIM coverage illusory or misleading — meaning Hartford collected premiums for a benefit it could then significantly reduce or eliminate when a claim was actually made.

Hartford denies any wrongdoing. The Court has not determined who is right.

Rather than continue the litigation, both sides agreed to a settlement offering eligible New Mexico policyholders two options: a partial return of premiums paid, or a full reevaluation of their UIM claim without the offset applied.

Who may qualify

  • You were a New Mexico policyholder with UIM coverage through Property and Casualty Insurance Company of Hartford between December 29, 2014 and March 18, 2022
  • OR you had UIM coverage through Hartford Insurance Company of the Midwest between January 1, 2019 and March 18, 2022
  • You submitted a UIM claim during the class period that was subject to an offset, OR you simply paid UIM premiums during that period

  2. Log in using your Unique ID and PIN from the notice you received by mail or email
  3. Choose your payment option: Option 1 (23% premium refund) or Option 2 (UIM claim reevaluation without offset)
  4. If you lost your notice or cannot locate your Unique ID and PIN, contact the Claims Administrator at 1-877-702-7792
  5. Alternatively, download a paper claim form from the Documents page, complete it with all required information, and mail it postmarked by May 22, 2026
  6. Wrongful death claimants do not need to file — payment will be sent automatically if eligible

Proof required

Payment timing

Option 1 payments will be issued no later than 60 days after the claim deadline. Payments will not be sent until the Court grants final approval and any appeals are resolved.

Extra details

You must choose between Option 1 and Option 2 — you cannot elect both. Once you choose the claim formula (Option 2) and a reevaluation is completed, you cannot switch to the premium formula regardless of the outcome.

If you already received full UIM benefits with no offset applied, you are not eligible for payment under Option 2.

Attorneys' fees and class representative awards are paid separately by Hartford and do not reduce your settlement payment.
