What happened

Class period: January 1, 2010 through December 31, 2021

  • A class action lawsuit -- Schwartz v. State Farm Mutual Automobile Insurance Company, et al., U.S. District Court for the District of New Mexico, Case No. 18-CV-000328-KWR-SCY -- alleges that State Farm Mutual Automobile Insurance Company, State Farm Fire and Casualty Company, and State Farm General Insurance Company violated New Mexico law in connection with the sale of the underinsured motorist (UIM) component of Uninsured and Unknown Motorist Coverage, known as "U Coverage"
  • The core allegation: State Farm did not explain at the time of sale the offset procedures required under New Mexico law -- known as "Schmick Offsets" -- when a UIM claim is adjusted
  • Additional legal claims include negligence, misrepresentation, violations of New Mexico's Unfair Trade Practices Act and Unfair Insurance Practices Act, and breach of the implied duty of good faith and fair dealing
  • State Farm denies all wrongdoing and no court has found otherwise; the parties have agreed to settle to avoid the cost and risk of continued litigation
  • The settlement class is limited to New Mexico policyholders only

  2. Log in using the Unique ID and PIN from the settlement notice you received by email or mail
  3. Complete and submit the Claim Form online -- you will receive a confirmation code by email
  4. Alternatively, download the Claim Form from the Documents page, fill it out, sign and date it, and mail it to the Settlement Administrator at P.O. Box 4359, Portland, OR 97208-4359

Who qualifies for this settlement?
You may qualify if you were insured under a New Mexico State Farm insurance policy that included U Coverage (Uninsured and Unknown Motorist Coverage) at any point between January 1, 2010 and December 31, 2021. If the Settlement Administrator sent you a notice by email or mail, you are likely a class member.
How much money could I receive?
Eligible class members may receive up to 21% of premiums paid for minimum limits U Coverage, or up to 13% of premiums paid for non-minimum limits U Coverage, for policies between 2010 and 2021. If total valid claims exceed the $20,925,000 settlement cap, all payments will be reduced proportionally.
What is the deadline to file a claim?
Claim forms must be submitted online or postmarked by July 2, 2026.
What do I need to file?
You will need the Unique ID and PIN from the settlement notice you received by email or mail. If you lost your notice or never received one, call the Settlement Administrator at 1-877-748-7791.
What if I want to opt out or object?
Both the opt-out deadline and the objection deadline are May 18, 2026. To opt out, mail a signed written exclusion request to the Settlement Administrator by that date. To object, file a written objection with the court and mail copies to Class Counsel and State Farm's counsel, also postmarked by May 18, 2026. Note: you cannot both opt out and object.
When will payments be sent?
Payments will be issued after the court grants final approval and any appeal period closes. The Final Fairness Hearing is scheduled for June 8, 2026. Check the official site for timing updates.
What if I do nothing?
If you do nothing, you will not receive any payment -- and you will still be bound by the settlement, giving up your right to sue State Farm separately over these claims. Filing takes a few minutes. The math on "do nothing" doesn't improve with time.
