Liberty Mutual UIM Settlement 2026 – New Mexico Drivers May Get Up to $25,000

Liberty Mutual and Safeco are settling a class action over claims that New Mexico drivers had their underinsured motorist benefits illegally reduced without proper disclosure. If you had a UIM claim offset between 2010 and 2022, you could claim up to $25,000. If you just had UM/UIM coverage during that period, you may get an automatic premium refund without filing anything. New Mexico: where the green chiles are hot and the insurance practices apparently were not.

What happened

Class period: October 1, 2010 through March 31, 2022

Liberty Mutual and its Safeco subsidiaries sold New Mexico auto insurance policies that included underinsured motorist (UIM) coverage, which is supposed to protect you when the at-fault driver's insurance does not fully cover your losses.

The lawsuit alleged that when policyholders filed UIM claims, Safeco improperly reduced or "offset" the payout by the amount the at-fault driver's insurer already paid, without giving required disclosures or offering the proper exclusion. This practice is known as a "Schmick offset" and the lawsuit says it violated New Mexico law.

Safeco denies all wrongdoing and maintains it followed the law, but agreed to a $6.5 million settlement to resolve the case rather than roll the dice at trial.

The case has been working its way through the courts since 2018, which is a long time to wait for your own insurance company to do right by you.

Extra details

If you receive an Offset Subclass Payment, you will not also receive the Direct Premium Refund. The two benefits are mutually exclusive.

If total valid Offset Subclass claims exceed $2,000,000, payments will be reduced pro rata. Any leftover funds from the offset pool roll into the Direct Premium Refund Fund.

If you lost your notice or do not have your Unique ID and PIN, call the Settlement Administrator at 1-877-684-5777 for help.

You cannot both opt out and object. Opting out surrenders your right to object since the settlement would no longer affect you.

The final approval hearing will be held on June 2, 2026, at 9:30 a.m. before Judge Judith C. Herrera at the Pete V. Domenici U.S. Courthouse, 333 Lomas Blvd NW, Suite 670, Albuquerque, NM 87102.

FAQ

Do I have to file a claim to get anything?
It depends on which group you are in. If your UIM claim was reduced or offset, yes, you must file by April 30, 2026, or you will not receive the Offset Subclass Payment. If you simply purchased UM/UIM coverage during the class period but never had an offset claim, no action is required. A Direct Premium Refund will be sent to you automatically.
How much will I actually receive?
For Offset Subclass members, up to $25,000 based on your documented offset amount, but payments may be reduced pro rata if total valid claims exceed $2,000,000. For Direct Premium Refund recipients, the amount is based on your share of the total UM/UIM premiums paid during the class period relative to the entire refund pool. In other words, it varies.
What if I never received a notice?
You may still be a class member. Call the Settlement Administrator at 1-877-684-5777 to find out if you are included and to get your Unique ID and PIN.
What is a Schmick offset and why does it matter?
A Schmick offset is when an insurer reduces your UIM payout by the amount the at-fault driver's insurer already paid. The lawsuit alleges Safeco applied this offset without providing the required disclosure or offering the proper exclusion under New Mexico law, which meant some policyholders received less than they were entitled to.
What if the at-fault driver had no insurance at all?
That would make it an uninsured motorist (UM) claim, not an underinsured motorist (UIM) claim. Unfortunately you are not eligible for an Offset Subclass Payment in that scenario. You may still qualify for the Direct Premium Refund if you purchased UM/UIM coverage during the class period.
Can I opt out and still get a refund?
No. Opting out means you receive no settlement benefits of any kind, but you retain the right to sue Safeco on your own.
