What happened
Class period: January 19, 2019 through the Effective Date of the Settlement
- Plaintiffs allege that wastewater disposal wells operated by the Settling Defendants -- Freedom Energy, Montclair, New Dominion, and H&P -- contributed to causing earthquakes in Oklahoma, including a 5.1 magnitude earthquake near Prague, Oklahoma on February 2, 2024, and other seismic events across the state dating back to January 2019.
- The lawsuit, filed in the District Court of Lincoln County, Oklahoma, asserts that the Settling Defendants' operations induced seismicity that caused measurable property damage to Oklahoma residents, municipalities, and tribal governments.
- The Settling Defendants deny all allegations and deny any liability or wrongdoing. Both sides agreed to a $2,600,000 settlement to avoid the costs and uncertainty of continued litigation.
- Anyone who owned real property -- or held a property interest -- within Oklahoma between January 19, 2019, and the Effective Date and who suffered earthquake-related damage may be a Settlement Class Member eligible to file a claim.

Who may qualify
- You are a person, municipality, county government, or tribal government that owned real property -- or had a property interest -- within Oklahoma between January 19, 2019, and the Effective Date
- Your property suffered earthquake damage from earthquakes, foreshocks, or aftershocks within the State of Oklahoma during that period
- You have not excluded yourself from the Settlement Class
- You are not a named defendant, officer, director, or employee of a Settling Defendant
- You are not a plaintiff in a separate active lawsuit against any Settling Defendant asserting earthquake damages (unless it is a Related Action)
How to file

- Fill out the Claim Form completely, including a specific sum-certain dollar amount for your claimed damages (not to exceed your documented repair estimates and bills)
- Attach supporting evidence of your earthquake-related property damage (repair estimates, invoices, contractor bills, photos, or other documentation)
- Submit your completed Claim Form online at the settlement website, by email to admin@OklahomaEarthquakesLawsuits2024.com, or by mail to the Settlement Administrator, postmarked no later than July 28, 2026

Proof required
- Repair estimates, contractor bills, or invoices documenting the cost of earthquake-related property damage
- Evidence supporting that damages were caused by the earthquakes referenced in the settlement (proximity, timing, damage type)
- Documentation of property ownership or property interest in Oklahoma during the class period
- Personal statements alone are not considered adequate documentation -- supporting records are required
Payment timing
Payments will be mailed within 30 days after the later of: (a) the Final Approval Order becoming final, (b) the claim deadline of July 28, 2026, or (c) resolution of all objections to claims or evidence deficiencies. - The settlement uses a two-zone system. Zone A covers properties in Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee, and Creek counties -- these claimants share 90% of the net fund because their properties are closest to the wastewater disposal wells and the Prague earthquake epicenter. Zone B covers the rest of Oklahoma and shares the remaining 10%.
- Your payout is based on your documented, approved repair amount as a proportion of all approved claims -- there is no fixed per-claimant cap, but you cannot claim more than your documented repair estimates and bills support.
- If total approved claims are less than the net fund, claimants receive their full sum-certain amount. If claims exceed the net fund, payments are reduced pro rata.
- Any leftover funds after approved claims are paid revert to the Settling Defendants in proportion to their contributions to the total fund.
- Claims against Progress Software Corporation (maker of MOVEit) are unrelated -- this is a separate matter involving induced seismicity from wastewater disposal wells.
