What happened
Class period: October 1, 2010 through January 31, 2022
- Metropolitan Direct Property and Casualty Insurance Company allegedly violated New Mexico law by applying a "Schmick offset" -- reducing underinsured motorist (UIM) claim payouts by the amount the at-fault driver's insurer had already paid.
- Plaintiffs allege Metropolitan misrepresented what UIM coverage actually covers and failed to disclose this limitation in written policy materials.
- The lawsuit includes claims for breach of contract, negligence, negligent misrepresentation, violations of New Mexico's Unfair Trade Practices Act and Unfair Insurance Practices Act, breach of the implied duty of good faith and fair dealing, and unjust enrichment.
- The settlement covers two groups: policyholders who had a UIM claim offset (and must file a claim), and those who simply purchased UM/UIM coverage during the class period (who receive an automatic refund).
- Metropolitan denies any wrongdoing. No court has made a finding that any law was violated.

Who may qualify
- Had an underinsured motorist (UIM) claim reduced or "offset" by the at-fault driver's insurance payout between October 1, 2010 and January 31, 2022 OR purchased a New Mexico automobile insurance policy containing UM/UIM coverage between October 1, 2010 and January 31, 2022
- Policy must have been issued by Metropolitan Direct Property and Casualty Insurance Company
How to file
- If your postcard notice included a Unique ID and PIN, go to the official website and submit your claim online
- Or download and print the claim form from the Documents page, sign it, and mail it to the Settlement Administrator
- Or call 1-877-239-5487 to request a paper claim form by mail
- Claim must be submitted online or postmarked by May 26, 2026
- If you purchased UM/UIM coverage during the class period but did NOT have a claim offset, no action is needed -- a check will be mailed to you automatically
Proof required
- Unique ID and PIN from your postcard notice, if applicable -- this identifies you as an Offset Subclass Member
- All claims are verified against Metropolitan's business records
- If you did not receive a Unique ID and PIN but believe you had an offset claim, you may print and submit a paper claim form by mail
