What happened

Class period: October 1, 2010 through January 31, 2022

  • Metropolitan Direct Property and Casualty Insurance Company allegedly violated New Mexico law by applying a "Schmick offset" -- reducing underinsured motorist (UIM) claim payouts by the amount the at-fault driver's insurer had already paid.
  • Plaintiffs allege Metropolitan misrepresented what UIM coverage actually covers and failed to disclose this limitation in written policy materials.
  • The lawsuit includes claims for breach of contract, negligence, negligent misrepresentation, violations of New Mexico's Unfair Trade Practices Act and Unfair Insurance Practices Act, breach of the implied duty of good faith and fair dealing, and unjust enrichment.
  • The settlement covers two groups: policyholders who had a UIM claim offset (and must file a claim), and those who simply purchased UM/UIM coverage during the class period (who receive an automatic refund).
  • Metropolitan denies any wrongdoing. No court has made a finding that any law was violated.

  • Policy must have been issued by Metropolitan Direct Property and Casualty Insurance Company

  2. Or download and print the claim form from the Documents page, sign it, and mail it to the Settlement Administrator

  4. Claim must be submitted online or postmarked by May 26, 2026
  5. If you purchased UM/UIM coverage during the class period but did NOT have a claim offset, no action is needed -- a check will be mailed to you automatically

Who qualifies for this settlement?
You qualify if you either (1) had a UIM claim reduced or "offset" by the at-fault driver's insurance payout between October 1, 2010 and January 31, 2022, or (2) purchased a New Mexico auto insurance policy with UM/UIM coverage through Metropolitan Direct during that same period.
Do I have to file a claim to get paid?
Only if your UIM claim was offset. If you purchased UM/UIM coverage during the class period but did not have a claim reduced, a check will be mailed to you automatically -- no action required.
How much can I receive?
Offset Subclass Members who file a valid claim may receive up to $25,000. The amount may be reduced pro rata if total claims exceed the fund set aside for that purpose. All other class members will receive a partial premium refund based on the UM/UIM premiums they paid during the class period, the size of the settlement fund after offset claims and fees, and the total number of eligible class members.
What is a Schmick offset?
It is a reduction of your underinsured motorist benefit by the amount the at-fault driver's liability insurer already paid. The lawsuit challenged whether this practice was properly disclosed and lawful under New Mexico law -- because if you bought UIM coverage specifically to fill the gap left by underinsured drivers, having that gap quietly re-applied is a reasonable thing to argue about.
What is the deadline to file a claim?
Claim forms must be submitted online or postmarked by May 26, 2026.
What if I want to opt out of the settlement?
You must mail a written exclusion request to the Settlement Administrator, postmarked by April 27, 2026. If you opt out, you give up your right to any settlement payment but keep the right to sue Metropolitan separately. You cannot both opt out and object.
