Discover Card Merchant Interchange Fee Settlement – Businesses File by May 18, 2026

Discover's tagline is "It pays to Discover" — and for 16 years, it apparently paid Discover quite well to misclassify consumer credit cards as commercial ones, routing higher interchange fees out of merchants' pockets in the process. A class action settlement now covers any business that accepted or processed Discover cards between 2007 and 2023. File your claim by May 18, 2026.

What happened

Class period: January 1, 2007 through December 31, 2023

Starting in 2007, Discover allegedly misclassified certain consumer credit cards — the rewards, premium, and premium plus variety — as commercial cards. The practical effect: merchants processing those transactions were charged higher interchange fees than they should have been. For 16 years. To be fair, "misclassification" can happen. What's harder to explain is how it kept happening, year after year, consistently in the direction that benefited Discover. Three related class action lawsuits were filed, covering Discover merchant interchange fee transactions processed between January 1, 2007 and December 31, 2023. Discover denies any wrongdoing but has agreed to settle.

FAQ

My business accepted Discover cards but I never received a notice. Can I still file?
Yes. Notices are being sent on a rolling basis and you do not need one to participate. You can register and file a claim at discovermerchantsettlement.com using your business's Taxpayer Identification Number. The deadline to file is May 18, 2026.
How much will my business actually receive?
That depends on the total interchange fee overcharges tied to your Discover merchant identifier codes (MIDs), how those fees were allocated among acquirers, intermediaries, and end merchants, and the total number of valid claims filed. You will receive a determination notice with your specific payment amount before any checks are issued, and you will have the opportunity to dispute it. The minimum payment is $10.
What is a MID and how do I find mine?
A MID is the merchant identifier code Discover uses in its systems to track transactions tied to your business. You can review the MIDs associated with your business on the Check My Discover MIDs page after registering with your Claimant ID and PIN. Your business may have more than one MID, especially if you changed payment processors over the years.
I received multiple notices with different Claimant IDs. Do I need to file separately for each?
You need to connect all Claimant IDs to your claim, but you do not need to file entirely separate claims for each. After submitting your first claim online, go to your My Claims page and use the Add Claimant IDs option to link any additional IDs. Each ID may be tied to different MIDs and missing one could mean leaving money on the table.
A third-party company contacted me offering to file my claim for a percentage of my recovery. Should I use them?
You are not required to, and they offer no advantage — think of them as the interchange fee of claims filing: a percentage taken out before you see a dime. Filing directly at discovermerchantsettlement.com is free and gets you the same result.
