Benefit Eligible Georgia customers who paid unreimbursed overdraft fees on ATM or debit card transactions between July 12, 2006 and April 15, 2014 will receive a pro rata share of the net settlement fund — calculated based on each account's total overdraft fees plus 7% simple annual interest accrued through December 31, 2025. The minimum payment per account is $5. Claim forms are not yet available and will be distributed after the court grants final approval.

What happened

Class period: July 12, 2006 – April 15, 2014

  • SunTrust Bank charged overdraft fees on ATM and debit card transactions — fees the lawsuit alleges constituted illegal interest under Georgia's usury laws, which cap the amount of interest a lender can charge
  • The lawsuit further alleged that SunTrust committed conversion and was liable under a theory of "money had and received" by collecting these fees
  • Charles Daniel Bickerstaff filed suit on July 12, 2010 — a case so determined it survived long enough to see SunTrust merge into an entirely different bank (now Truist) before reaching settlement
  • The Georgia Court of Appeals weighed in as recently as February 2025, narrowing the class to exclude account holders who closed their accounts before June 1, 2010, and capping eligible overdraft fees at those charged before April 15, 2014, when Georgia amended its usury laws
  • SunTrust denies all wrongdoing and denies that its overdraft fees constitute interest, but agreed to a $240 million settlement to end sixteen years of litigation

Extra details

  • This case has been in litigation since July 12, 2010 — if you feel like you've been waiting a while for your overdraft fees back, the math checks out
  • The Georgia Court of Appeals issued a ruling as recently as February 20, 2025 that shaped the final settlement class, excluding accounts closed before June 1, 2010 and capping eligible fees at those charged before April 15, 2014
  • Prejudgment interest of 7% simple interest per year accrues on each account's overdraft fee total from the date the account reached a positive balance through December 31, 2025 — so the longer the wait, the more interest has been tacking on
  • SunTrust is now part of Truist Bank following a 2019 merger; do not contact Truist directly about this settlement, as they cannot assist with claims
  • Class Counsel is requesting attorneys' fees of up to 33⅓% of the $240 million settlement fund (up to $80 million), plus up to $3 million in expenses; the Court may award less
  • Class Representative Charles Daniel Bickerstaff may receive an incentive payment of up to $200,000 for his 16 years of service to the class
  • All Settlement Class Members release their claims against SunTrust regardless of whether they submit a Claim Form or receive any payment — so there is no benefit to doing nothing except not getting paid

FAQ

What is this lawsuit about?
A Georgia SunTrust account holder alleged that the bank's overdraft fees on ATM and debit card transactions legally constituted interest — and that by charging them, SunTrust violated Georgia's usury laws, which cap how much interest a lender can charge. The lawsuit also alleged conversion and unjust enrichment. SunTrust denies all of it, but agreed to settle for $240 million rather than keep litigating a case that was already old enough to vote.
Who is eligible for a payment?
Georgia citizens who had a SunTrust account that wasn't closed before June 1, 2010, paid unreimbursed overdraft fees on ATM or debit card transactions of $500 or less between July 12, 2006 and April 15, 2014, and maintained continuous Georgia citizenship from July 12, 2010 through October 6, 2017. If you received a mailed or emailed notice, SunTrust's records already flag you as a likely class member.
How much will I receive?
It depends on how much you paid in eligible overdraft fees and how many people file valid claims. Each account's payout is calculated by adding up all eligible unreimbursed overdraft fees, adding 7% simple annual interest accrued through December 31, 2025, and then calculating that account's proportional share of the total net settlement fund. The minimum payment per account is $5. The settlement website will publish distribution details once claim forms are released.
Why isn't the claim form available yet?
The Court must first approve the settlement at the May 26, 2026 Fairness Hearing. Once it does — and assuming there are no appeals that derail things — claim forms will be mailed and emailed to class members. The deadline to submit will be announced at that time. In the meantime, make sure your address is current with the Settlement Administrator so your form actually reaches you.
Do I need to submit any documents or proof of my overdraft fees?
No. SunTrust's own account records identify class members and their fee amounts. The only thing you'll need to affirm on the Claim Form is that you were a U.S. citizen who made Georgia your home on July 12, 2010 and remained a Georgia citizen through October 6, 2017.
What if I have a joint account with another class member?
You each need to submit your own Claim Form for that account. If both of you file, the account's settlement payment is split equally between you. If only one person files, that person collects the full amount for the account.
Can I opt out of the settlement?
Yes, but the deadline is April 20, 2026 (postmarked), received by May 4, 2026. To opt out, mail a written request to the Settlement Administrator that includes your name, address, phone number, the case name and number, a clear statement requesting exclusion, and your signature. If you opt out, you will not receive any settlement payment but retain the right to pursue your own claims against SunTrust.
What happens if I do nothing at all?
Right now, doing nothing is fine — claim forms aren't available yet. Once they are, however, failing to submit by the deadline means you get nothing. You'll still be bound by the settlement and release your claims against SunTrust, meaning you'd give up your legal rights without receiving a dime. Definitely file when the time comes.
I banked with SunTrust, but they're now Truist. Does that affect my claim?
No — the settlement covers SunTrust's conduct during the class period regardless of the subsequent merger with BB&T that created Truist. Just don't contact Truist about this settlement; they can't help you. All questions should go to the Settlement Administrator.
How do I get more information or update my address?
Call 1-877-239-8765, email info@SunTrustOverdraftClassAction.com, or write to the Settlement Administrator at P.O. Box 2873, Portland, OR 97208-2873. Updating your address is especially important right now — since claim forms will be mailed after court approval, a stale address means a missed payment.
