What happened

Class period: January 1, 2017 through December 29, 2025

Athena Cosmetics, Inc., the manufacturer of RevitaLash and RevitaBrow serums, is facing a class action lawsuit alleging that its labeling and marketing of four products failed to disclose material information about an ingredient and the potential risks and side effects associated with it. The products at issue are RevitaLash Advanced Eyelash Conditioner, RevitaLash Advanced Sensitive Eyelash Conditioner, RevitaLash Advanced Pro Eyelash Conditioner, and RevitaBrow Advanced Eyebrow Conditioner.

Athena denies all allegations, denies any wrongdoing, and maintains that its products are safe and comply with all state and federal regulations. No court has found Athena liable. The parties agreed to a settlement totaling $4,170,000 to avoid the costs and uncertainty of continued litigation.

4. If you have a receipt or order confirmation, include it with your claim to maximize your payout (proof of purchase allows claims per product rather than one per household)

Proof required

• Proof of purchase is optional but recommended. Claimants who provide proof of purchase (receipt, order confirmation, or appearance in Athena's records) can claim a cash payment per product purchased and may also claim both a cash benefit and a voucher.
• Claimants without proof of purchase are limited to one cash payment per household and one voucher per household.
• No proof of purchase is required to file a claim, but providing it increases what you can receive.

Payment timing

Cash payments will be issued within 21 days after the settlement receives final court approval and any appeals are resolved. Class members may choose to receive payment electronically via PayPal, Venmo, Zelle, or other digital methods, or by paper check. Vouchers are non-expiring and can be used at any time after the settlement becomes final.

Proof of purchase unlocks significantly better benefits. Without it, you are limited to one cash payment and one voucher per household. With it, you can claim a cash payment for each product purchased and receive both cash and a voucher.

The $110 voucher is non-expiring, transferrable, can be combined with other promo codes, and does not need to be used all at once.

The cash payment amount is currently unknown and will depend on the total number of valid claims filed. The minimum cash payment is $20 per claimant.
