What happened

Class period: January 1, 2020 through July 25, 2024 (Subclass 1 portal/appointment activity: January 1, 2020 – December 31, 2023)

  • A class action lawsuit, Kaplan v. Northwell Health, Inc., Case No. 520763/2025, was filed in New York State Supreme Court, Kings County
  • The lawsuit claims that Northwell Health, Inc. used tracking technologies on its website and patient portal that allegedly disclosed patients' personally identifiable information (PII) to third parties without consent — think invisible data crumbs being swept up by third-party trackers
  • The alleged violations include the Electronic Communications Privacy Act (ECPA) and other state and federal statutes
  • Northwell denies all wrongdoing; the parties agreed to settle to avoid the costs and uncertainty of continued litigation
