What happened

Class period: January 31, 2018 through January 7, 2026

Plaintiffs Tristan Hurd and Ken DiMicco filed a class action lawsuit alleging that G.Skill International Enterprise Co., Ltd., G.Skill USA, Inc., Neuteck, Inc., and Racerspeed, Inc. deceptively advertised the speeds of their DDR-4 and DDR-5 non-laptop DRAM memory products. Plaintiffs allege they were misled into believing the advertised speeds were achievable right out of the box, when in reality they required BIOS adjustments or overclocking. G.Skill denies all wrongdoing and denies violating any law. Both parties agreed to settle to avoid the costs and uncertainties of continued litigation.

Who may qualify

  • All U.S. residents who purchased one or more G.Skill DDR-4 (non-laptop) memory products with a rated speed over 2133 MHz, or G.Skill DDR-5 (non-laptop) memory products with a rated speed over 4800 MHz, between January 31, 2018 and January 7, 2026, while residing in the United States.

Proof required

  • Proof of purchase is not required for claims of 5 or fewer products per household. Households claiming more than 5 products must provide proof of purchase upon request.

Payment timing

Check or electronic payment, approximately 45 days after the Settlement receives final court approval and any appeals are resolved. All checks expire and become void 180 days after issuance.

Class Counsel is the law firm Dovel & Luner. Their fee petition will seek no more than one-third of the Settlement Fund, plus reimbursement of reasonable costs. Each Class Representative may receive up to $5,000 from the Settlement Fund, subject to Court approval. If approved, G.Skill will also be required to label rated speeds as "up to" speeds with the following disclosure: "Requires overclocking/BIOS adjustments. Maximum speed and performance depend on system components, including motherboard and CPU." Uncashed check funds may be donated to Court-approved charities if appropriate.
