What happened
Class period: Toyota IC forklifts built between 2007 and 2021, purchased or leased on or before January 20, 2026.
Plaintiffs allege that Toyota Material Handling, N.A., Toyota Material Handling, Inc., and Toyota Industries Corporation misrepresented the emissions certification of certain internal combustion (IC) forklifts sold in the United States, and that real-world emission levels exceeded regulatory limits.
The forklifts at issue were built between 2007 and 2021. Defendants deny the allegations, and the court has not ruled on the merits.
Rather than slug it out in federal court, both sides agreed to a $299,500,000 settlement -- which, for operators who spent years moving pallets with these machines, is at least something to show for it.
The settlement covers any person or entity that purchased or leased a Settlement Class Forklift on or before January 20, 2026.

Who may qualify
- Purchased or leased a Settlement Class Forklift in the United States on or before January 20, 2026
- Forklift is a Toyota IC model originally sold or leased in the United States
- Forklift is equipped with one of the following engines for the indicated emissions certification years: 4Y (2007--2021), 1FS (2013--2021), 1KD (2014--2021), or 1ZS (2014--2021)

- Model number and serial number of the forklift
- Additional supporting documents may be requested by the Settlement Administrator if your claim is incomplete
Payment timing
Payments are expected to be issued in late 2026 at the earliest, after the Settlement's Effective Date. The Effective Date depends on when the Court enters its final approval order and whether any appeals are filed. - The Service Plan visit is separate from the cash claim -- you do not need to file a claim form to schedule it. Contact your local authorized Toyota Material Handling dealer with your forklift's model and serial number. You have three years from the Settlement's Effective Date to schedule this visit (currently estimated through August 8, 2029).
- The New Parts Warranty is not guaranteed -- it only kicks in if Toyota issues a government-authorized recall for Settlement Class Engines by October 31, 2028.
- The settlement is non-reversionary, meaning any unclaimed funds will not be returned to the defendants. If economically feasible, leftover money will be redistributed to class members; otherwise it will go to court-approved charitable causes.
- Settlement Class Counsel may request up to 25% of the settlement fund (up to $74,875,000) in attorneys' fees, plus up to $500,000 in costs. These are paid from the settlement fund -- not by class members directly.
- You cannot both object to the settlement and opt out. Pick one lane.
