What happened

Class period: Toyota IC forklifts built between 2007 and 2021, purchased or leased on or before January 20, 2026.

Plaintiffs allege that Toyota Material Handling, N.A., Toyota Material Handling, Inc., and Toyota Industries Corporation misrepresented the emissions certification of certain internal combustion (IC) forklifts sold in the United States, and that real-world emission levels exceeded regulatory limits.

The forklifts at issue were built between 2007 and 2021. Defendants deny the allegations, and the court has not ruled on the merits.

Rather than slug it out in federal court, both sides agreed to a $299,500,000 settlement -- which, for operators who spent years moving pallets with these machines, is at least something to show for it.

The settlement covers any person or entity that purchased or leased a Settlement Class Forklift on or before January 20, 2026.

  • The Service Plan visit is separate from the cash claim -- you do not need to file a claim form to schedule it. Contact your local authorized Toyota Material Handling dealer with your forklift's model and serial number. You have three years from the Settlement's Effective Date to schedule this visit (currently estimated through August 8, 2029).
  • The New Parts Warranty is not guaranteed -- it only kicks in if Toyota issues a government-authorized recall for Settlement Class Engines by October 31, 2028.
  • The settlement is non-reversionary, meaning any unclaimed funds will not be returned to the defendants. If economically feasible, leftover money will be redistributed to class members; otherwise it will go to court-approved charitable causes.

In the unlikely event that every eligible forklift generates a claim, the per-forklift amount could be approximately $820. If more than one person submits a claim for the same forklift, the original owner gets 60% and the remaining 40% is split among other claimants.
What is the deadline to file a claim?

What is the Service Plan visit, and do I have to file a claim to get it?
The Service Plan visit is a free, on-site inspection of your eligible forklift performed by a certified technician from an authorized Toyota dealer. It covers all major systems and includes an oil change or transmission fluid change. You do not need to file a cash claim to get this visit -- just contact your local authorized Toyota Material Handling dealer with your forklift's model and serial number. You have until approximately August 8, 2029 to schedule it.
What is the opt-out deadline?
June 1, 2026. If you want to preserve your right to sue Toyota separately over these issues, you must opt out in writing by that date.
When will payments be sent?

What if I do nothing?
You will not receive a cash payment, and you will still be bound by the settlement's release provisions -- meaning you give up the right to sue the defendants separately.
