What happened

Tom's of Maine -- the natural toothpaste brand owned by Colgate-Palmolive -- found itself in a sticky situation after an FDA inspection of its Sanford, Maine manufacturing facility in May 2024. The FDA raised concerns that certain conditions at the facility were not in compliance with Current Good Manufacturing Processes. The defendants reviewed pre-release testing data for approximately 4,900 finished toothpaste batches manufactured over a three-year period and found no batch showed a safety risk to consumers -- but that didn't stop the lawsuits.
Multiple class action cases were filed across the country, alleging deceptive and misleading business practices related to the manufacturing, marketing, and sale of Tom's toothpaste products. The cases were consolidated into Rabinowitz et al. v. Colgate-Palmolive Company et al., filed in the U.S. District Court for the Eastern District of New York. Colgate and Tom's deny all wrongdoing but agreed to a $2,900,000 settlement to resolve the litigation.
