What happened

Class period: November 7, 2018 through February 10, 2026

  • Plaintiff Rochell Brent Dortch alleges that State Farm Mutual Automobile Insurance Company breached its Alabama auto insurance policies by failing to include full "Purchasing Fees" in total loss claim payments
  • "Purchasing Fees" include Alabama state sales tax (2%, excluding city tax), applicable county sales tax, ad valorem taxes and ad valorem refund credit fees, and state, county, and city license fees, tag fees, and school fees
  • In plain terms: when State Farm totaled a policyholder's car and cut them a check, it allegedly left out taxes and registration-related fees they were owed under their policy
  • The case is Rochell Brent Dortch v. State Farm Mutual Automobile Insurance Company, Case No. 03-CV-2024-901729.00, Circuit Court of Montgomery County, Alabama
  • State Farm denies any wrongdoing, fault, or liability; the court has not determined that State Farm violated any law

FAQ

Who qualifies for the State Farm Alabama settlement?
Alabama policyholders who had a State Farm first-party private passenger auto total loss claim paid between November 7, 2018, and February 10, 2026, and whose payment did not include full Purchasing Fees -- meaning sales tax, ad valorem taxes, and license or tag fees. If you received a mailed or email notice, State Farm's records suggest you may be eligible.
What are "Purchasing Fees" and why do they matter?
Purchasing Fees include Alabama state sales tax (2%, excluding city tax), applicable county sales tax, ad valorem taxes and refund credit fees, and state, county, and city license, tag, and school fees. Plaintiffs allege State Farm was required to include these fees in total loss payments under its policies -- and didn't.
How much will I receive?
$20.50, flat. Every eligible class member who submits a valid and timely claim receives the same amount. The attorneys' fees and service award are paid separately by State Farm and do not come out of your payment.
How do I file a claim?
Go to alabamafeesettlement.com and click "Make a Claim." You'll need either your Claimant ID (from your mailed or email notice) or your State Farm policy number and claim number. You can also mail back the pre-filled paper form included in the mailed notice. Either way, your claim must be submitted or postmarked by July 15, 2026.
What is the deadline to file?
July 15, 2026 -- online or postmarked by mail. Note that the deadline to opt out or object is earlier: May 15, 2026.
What if I want to opt out?
Mail a written exclusion request to Kroll Settlement Administration LLC, P.O. Box 5324, New York, NY 10150-5324, postmarked by May 15, 2026. Your request must include your name, address, phone number, a clear statement that you want to be excluded, and your signature. Opting out preserves your right to sue State Farm separately but gives up your right to the $20.50 payment.
When is the final approval hearing?
June 15, 2026, at 9:00 a.m. CST, at the Montgomery County Courthouse. You do not need to attend. The date could change, so check alabamafeesettlement.com for updates.
What happens if I do nothing?
You stay in the class and release your claims against State Farm for unpaid Purchasing Fees -- but you receive no payment. You have to actually file a claim to get paid. Doing nothing is the one option that costs you twice.
