What happened

Class period: Data incident occurred on February 7, 2024. The settlement class includes individuals notified of potential impact on or around that date.

On February 7, 2024, an unauthorized third party accessed SouthState Bank's computer network and walked off with sensitive customer data -- names, dates of birth, addresses, phone numbers, financial account numbers, and Social Security numbers. The bank began notifying affected customers on March 29, 2024.

Multiple lawsuits followed, alleging negligence, breach of contract, breach of fiduciary duty, and unjust enrichment -- essentially that the bank failed to put adequate cybersecurity protections in place. SouthState Bank denies all wrongdoing, but agreed to a $1.5 million settlement to resolve the claims.

If you received a notice that your information may have been impacted, this settlement affects you.

FAQ

Who qualifies for this settlement?
You qualify if you live in the United States and received a notice that your Private Information may have been impacted in the SouthState Bank data incident on February 7, 2024.
What can I get from this settlement?
You may file for up to $3,500 in reimbursement for documented losses tied to the breach (Cash Payment A), a proportional cash payment from whatever remains in the $1.5 million fund (Cash Payment B), or both. Every class member who stays in the settlement also gets one free year of credit monitoring with $1 million in identity theft insurance -- no claim needed for that part.
What is the deadline to file a claim?
June 15, 2026. Claims must be submitted online by 11:59 p.m. ET or mailed postmarked by that date.
What losses are covered under Cash Payment A?
Covered losses include bank fees, overdraft or late charges, costs to place or remove a credit freeze, credit monitoring you purchased in response to the breach, professional fees (accountants, fraud specialists, attorneys), replacement costs for government-issued ID, and fraudulent unreimbursed charges traceable to misuse of your information -- all incurred after February 7, 2024.
What proof do I need to file?
For documented losses (Cash Payment A), you need third-party documents such as bank statements, credit card statements, invoices, phone records, or receipts. Personal affidavits will not be accepted on their own. For the pro rata cash payment (Cash Payment B), no documentation is required.
Do I need to do anything to get the credit monitoring?
No. It's automatic for all class members who don't opt out. Check your notice for your unique activation code. Enrollment instructions will be posted at southstatebankdatasettlement.com once the Court grants Final Approval.
What is the opt-out deadline?
May 15, 2026. To opt out, mail a written request to the Settlement Administrator that includes the case name and number, your name, address, phone number, email address, a statement that you want to be excluded, and your personal signature.
What happens if I do nothing?
You won't receive a cash payment, and you give up the right to sue SouthState Bank over this incident. You can still activate your credit monitoring code. In other words: free credit monitoring is the consolation prize for not filing. It's not nothing, but it's also not $3,500.
When will I receive my payment?
After the Final Approval Hearing, scheduled for June 22, 2026, and after any appeals are resolved. No guaranteed payment date has been set. Check southstatebankdatasettlement.com/dates/ for updates.
