What happened

Inova Health Care Services, a Virginia-based hospital and health system, used third-party tracking pixels from Facebook and Google on its public-facing patient websites, including its MyChart patient portal.

The lawsuit alleged that these tracking pixels collected patients' personally identifiable information and protected health information and transmitted it to Meta and Google without patient authorization, violating the federal Electronic Communications Privacy Act (ECPA).

Inova disputes that any protected information was shared and maintains it did nothing wrong. It agreed to settle anyway to avoid the cost and uncertainty of continued litigation, which is a time-honored tradition in class action law.

The settlement fund is $3,147,390.04. Every eligible class member who files a valid claim receives an equal share after attorneys' fees, administration costs, and the class representative service award are deducted.
