What happened

Class period: December 3, 2014 through March 13, 2026

In 2015, Grubhub delivery driver Raef Lawson filed a lawsuit alleging that Grubhub violated California labor law by classifying its delivery drivers as independent contractors rather than employees. The case -- Lawson et al. v. Grubhub Holdings Inc. et al., Case No. 15-cv-05128 JSC -- was filed in the United States District Court for the Northern District of California.

The lawsuit claims Grubhub failed to reimburse drivers for necessary business expenses, failed to pay minimum wages and overtime, and that Grubhub had not met the conditions required for Proposition 22 to apply to its drivers. The court previously found that Plaintiff Lawson himself had been misclassified for purposes of minimum wage and overtime claims.

Grubhub denies all allegations and denies that drivers were or are employees. After more than ten years of litigation and five formal mediation sessions, the parties agreed to a $24,750,000 settlement. Anyone who used the Grubhub platform as an independent contractor delivery driver and completed at least one delivery in California between December 3, 2014, and March 13, 2026, may be eligible.

FAQ

Who qualifies for this settlement?
Any person who used the Grubhub platform as an independent contractor delivery driver and completed at least one delivery in California between December 3, 2014, and March 13, 2026, is a member of the Settlement Class.
What is the deadline to file a claim?
June 18, 2026. If you miss this deadline, you will not receive a payment -- but you may still be bound by the settlement's release of claims.
How much money will I receive?
The exact amount depends on how many miles you drove using the Grubhub app during the class period, based on Grubhub's records. Every eligible claimant who submits a valid claim will receive at least $25. The more miles on record, the larger your share. Think of it as getting paid retroactively per mile -- just without the tips.
Do I need to submit any proof or documentation?
No independent documentation is required. Your payment will be calculated using Grubhub's own delivery records.
What if I don't do anything?
You will remain in the Settlement Class and release your claims against Grubhub, but you will not receive any payment. You must actively submit a claim to get paid.
Can I still opt out of the settlement?
Yes. You must submit a written opt-out request postmarked no later than June 18, 2026. If you opt out, you receive no money but retain the right to sue Grubhub individually for the claims in this case. Note that PAGA claims are released for all class members regardless of opt-out status.
When will payments be sent?
Approximately 30 days after the settlement becomes final. If the court approves the settlement at the July 30, 2026 hearing and no objections or appeals follow, payments are expected to be mailed within a couple of months after that date.
How do I contact the settlement administrator?
You can reach Simpluris, the Claims Administrator, by phone at (833) 386-6491, by email at info@GrubhubCalSettlement.com, or by mail at Lawson et al. v. Grubhub Holdings Inc. et al., c/o Claims Administrator, P.O. Box 26170, Santa Ana, CA 92799.
