What happened

Class period: August 3, 2024 through August 6, 2024

Between August 3 and August 6, 2024, Avis Rent A Car System experienced a data security incident in which unauthorized parties exfiltrated customers' personally identifiable information. The compromised data includes names, driver's license information, credit card numbers and expiration dates, dates of birth, and phone numbers.

A class action lawsuit -- In re: Avis Rent A Car System, LLC Security Incident Litigation, Case No. 2:24-cv-09243 -- was filed in the United States District Court for the District of New Jersey on behalf of all U.S. residents whose private information was exposed. Avis denies any wrongdoing, but both sides agreed to settle to avoid the costs and uncertainty of continued litigation.

If you received a notice from Avis or have reason to believe your information was compromised in this incident, you may be eligible to file a claim. You rented a car. They lost your data. The least they can do is send you something back.

FAQ

Who qualifies for the Avis data breach settlement?
You qualify if you are a U.S. resident whose personal information was compromised in the Avis data security incident that occurred between August 3 and August 6, 2024. Avis may have sent you a notice -- but if you believe your information was affected and you did not receive one, you can still contact the claims administrator at 1-888-818-4234 to confirm your eligibility.
What information was exposed in the Avis data breach?
The compromised data may include your name, driver's license information, credit card number and expiration date, date of birth, and phone number. In other words, the kind of information you'd really rather keep to yourself.
What can I get from the settlement?
Two things. First, if you suffered documented out-of-pocket losses because of the breach -- think fraud charges, identity theft costs, credit monitoring you paid for -- you can claim up to $5,000 in reimbursement. Second, every eligible class member who files a valid claim can receive a pro rata cash payment from whatever is left in the settlement fund after expenses. You do not need documented losses to receive the pro rata payment.
What is the deadline to file a claim?
June 21, 2026. Claims must be submitted online or postmarked by that date. Do not wait -- the deadline is firm.
What proof do I need to submit?
For the pro rata cash payment, no documentation is required beyond the completed claim form. For out-of-pocket loss reimbursement, you must submit documentation -- such as receipts, bank statements, or bills -- showing the loss was real, unreimbursed, and caused by the breach.
What happens if I do nothing?
You stay in the settlement class, you give up your right to sue Avis over this incident, and you receive nothing. All three of those outcomes are avoidable with one claim form.
How do I opt out of the settlement?
Send a signed, written request for exclusion postmarked by May 22, 2026 to: Avis Data Security Incident Litigation, Attn: Exclusions, P.O. Box 58220, Philadelphia, PA 19102. Opting out means you get no settlement benefits but keep your right to pursue your own legal action against Avis.
When will payments be sent?
Payments will go out after the Court grants final approval of the settlement and any appeals are resolved. The Final Approval Hearing is currently scheduled for July 28, 2026. Check avisdatasecuritysettlement.com for the latest updates on timing.
